T'he board asked why a 6-foot fence <br />was chosen. The applicants felt that the children and dog could climb over a 4 foot fence. If the <br />fence was 50% open the dog and children could squeeze through the openings. The board did <br />not feel that the fence would have an adverse impact on neighboring sites or traffic. The <br />variances are not substantial nor does it affect the overall appearance of the neighborhood. <br />W. Kremzar moved to grant Mr. & Mrs. William Plank of 4589 Columbia Road tbeir <br />request for variance (1123.12), which consists of a new fence and that the following <br />variances are granted: <br />1. A 25 foot vapiance for a 6' privacy fence located in a neighbors 50' setback on a corner <br />lot, (code requires 501, applicant shows 25'), section (1135.02 (fZ)). <br />2. A 42 inch variance for a fence higher fhan code allows on a corner lot in a 50' <br />neighbors setback, (code permits 30", applicamt shows 72"), section (1135.02 (fl)). <br />3. A variance for a fence less than 50°/a open on a corner lot in a neiglabors 50' setback, <br />(code requires 50% open, applicant shows solid), section (1135.02 (fl)). <br />4. An 11 foot variance for a fence (dog run) located in a neighbors 50' setback on a corner <br />lot, (code requires 50', applicant shows 39'), section. (1.135.02 (f2)) (see note). <br />5. An 18 inch variance for a fence higher than code allows on acorner lot in a neighbors <br />50' setback, (code requires 30", applicant shows 487), section (1135.02 (fl)) (see note). <br />Which is in violation of Ord. 90-125 sections (1135.02 (fl)) and 1135.02 (f2)). M. IDiver <br />seconded the motion which was unanfmously approved. Variances Granted. <br />3. Mark McCollaugh; 23820 Lorain Itoad: (WRD # 2) <br />Request for variance (1123.12). The proposal consists of a storage shed. <br />The following variances are requested: <br />1). A 1,400 square foot variance for a storage building larger than code allows, (code permits <br />200 sq ft, applicant shows 1,600 sq ft), section (1135.02 (D 1)). <br />2). A 1 foot 4 inch variance for an accessory structure higher than code a.llows, (code permits <br />12', applicant shows 13' 4"), section (1135.02 (D3)). <br />Which is in violation of Ord. 90-125 sections (1135.02 (D1)) and (1135.02 (133)). <br />Note: See Building Commissioners letter dated 10/26/05. <br />Mr. Pyles, a friend of the applicant came forward to be swom in and address the request. Mr. <br />O'Ma11ey advised that unless the gentleman was the applicant's attorney or contraetor he could <br />not address the board on the matter and the matter should be tabled. He apologized to the <br />neighbor who was present and advised that without the applicant present the matter could not be <br />addressed. <br />J. Sergi seconded the <br />motion which was unanimously approved. <br />4. Red Lobster 25615 Brooknark Road: (WRD #4) <br />Request for variance (1123.12). T'he proposal consists of sign package. <br />The following variances are requested: <br />1). A variance for more than 1 wall sign on a building, (code pernuts 1, applicant shows 3), <br />section (1163.27 (A)). <br />2). A 40 square foot variance for a flag larger than code permits, (code permits 20 sq ft, . <br />applicant shows 60 sq ft), section (1163.32 (E)). <br />3).
