BOARD OF ZONING APPEALS 2005 REPORT <br />"no", with the following comments; the property can be used and yield a reasonable return <br />without the variance. The variance requested is substantial and the character of the neighborhood <br />would be altered, but the variance would not adversely affect the delivery of governmental <br />services. It is assumed that the land conformed to code when purchased but zoning requirements <br />had changed and the owners predicament can be precluded by constructing a smaller room. <br />Although she likes the look of the room it does not meet the 7 requirements for granting a <br />variance. W. Kremzar "no" for the same reasons as Mr. Diver and the fact that the building is <br />already non-conforming and the proposal is to increase the non-conformity further. J. Maloney <br />"no" the room size is encroaching the rear to much as the room is enlarging the non-conformity. <br />Variance Unanimously Denied 7/7/05 Mr. Parikh requested something in writing as to why he <br />was denied. The clerk advised that he was welcome to a copy of the minutes once they were <br />transcribed. <br />Bryan & Janice Tench; 24357 Woodmere Drive: (WRD 2) <br />W. Kremzar moved to grant Bryan & Janice Tench of 24357 Woodmere Drive their request for <br />variance (1123.12), which consists of a pool and that the following variance is granted: 1. A 161 <br />square foot variance for swimming pool in rear yard, (code permits 728 sq ft, applicant shows 889 <br />sq ft(garage, deck & pool). Which is in violation of Ord. 90-125 section (1135.02 (d2)). J. <br />Maloney seconded the motion, roll call on the motion; W. Kremzar "no" the variance was <br />substantial and a smaller pool is available. M. Diver "no" she wished a smaller pool was <br />available to the applicants and wished contractors would advise their clients to check with their <br />City before purchasing a pool so residents would not have to go through the variance process. J. <br />Maloney "no". Variance Denied 7/7/05 <br />C& C Realty; 27932 Lorain Road: (WRD 1) <br />J. Maloney moved to reconsider C& C Realty of 27932 Lorain Road their request for their <br />variance requests from June 2, 2005 Board of Zoning Appeals meeting numbers #3, #4, and #6 <br />which were denied be reconsidered. W. Kremzar seconded the motion which was unanimously <br />approved. During roll call of the motion W. Kremzar stated it was difficult not having an <br />opportunity to read what was submitted therefore out of a courtesy to the applicant he would be <br />for the reconsideration. M. Diver concurred with Mr. Kremzar's comment and hoped the <br />applicant would stick to his word and show the board something different. Reconsideration <br />Granted 7/7/05 <br />W. Kremzar moved to table C& C Realty of 27932 Lorain Road their request for a use variance <br />to the August 4, 2005 Board of Zoning Appeals meeting. J. Maloney seconded the motion which <br />was unanimously approved. 7/7/05 <br />B.A.D. Bovs Ltd; 28597 Lorain Road: (WRD 3) <br />W. Kremzar moved to grant B.A.D. Boys Ltd of 28597 Lorain Road their request for variance <br />(1123.12), which consists of a new development and that the following variances are granted as <br />amended: <br />1. A 60 foot variance for minimum distance from residential property line to luminaries, (code <br />requires 180 ft, applicant shows 120 ft), section (1161.12 (E)). <br />2. A.1 foot candle variance for minimum foot candle in a parking lot, (code requires .1 <br />minimum, applicant shows .0), section (1161.12 (C) Table). <br />Which is in violation of 90-125, Sections (1161.12 (E)), (1161.12 (C)Table). M. Diver seconded <br />the motion which was unanimously approved. Variances Granted 7/7/05 <br />Michael Murray; 26817 Sudbury Drive: (WRD 1) <br />W. Kremzar moved to grant Michael Murray of 26817 Sudbury Drive his request for variance <br />(1123.12), which consists of a storage shed and that the following variance is granted: 1. A 35 <br />11
