BOARD OF ZONING APPEALS 2005 REPORT <br />Clerks Note: The Board of Zoning Appeals Board granted this applicant reconsideration at their <br />7/7/05 meeting. <br />B A D. Boys Ltd• 28597 Lorain Road: (WRD 3) <br />Mr. Maloney called all interested parties forward, however as no one came forward the chairman <br />advised that the case would be addressed at the end of the docket. After all cases were completed <br />again the chairman called for all interested parties to come forward and again no one came <br />forward. Mr. Maloney advised the clerk to remind the applicants that it is mandatory to have a <br />representative present at the meeting. Therefore, B.A.D. Boys Ltd of 28597 Lorain Road is <br />tabled until meeting next. 6/2/05 <br />N O Town Center (Parcel E) 24642-25174 Brookpark Road: (WRD 4) <br />J. Maloney moved to grant N.O. Town Center (Parcel E) of 24642-25174 Brookpark Road their <br />request for variance (1123.12), which consists of a sign package and that the following variances <br />are granted as amended: <br />1. A variance for 5 ground signs and 1 additional ground sign A east with the condition that a <br />second curb cut is granted by O.D.O.T. onto Brookpark Road, (code permits 2, applicant <br />shows 6), section (1163.26 (A)). <br />2. A 155 foot variance for ground sign too close together sign B west & sign A, (code requires <br />200', applicant shows 45'), section (1163.26 (A)). <br />3. A 155 foot variance for ground sign to close together sign B east & sign A, (code requires <br />200', applicant shows 45'), section (1163.26 (A)). <br />4. A 71 square foot variance for a ground sign larger than permitted (sign B-2 west), (code <br />permits 65 sq ft, applicant shows 136 sq ft), section (1163.26 (C)). <br />5. A 71 square foot variance for a ground sign larger than permitted (sign B-2 east), (code <br />permits 65 sq ft, applicant shows 136 sq ft), section (1163.26 (C)). <br />6. A 110 foot variance for ground sign too close (signs B east and B west), (code requires 200', <br />applicant shows 90'), section (1163.26 (A)). <br />7. A 200 foot variance for ground signs too close (sign B 1- B2 east), (code requires 200', <br />applicant shows 0'), section (1163.26 (A)). <br />8. A 200 foot variance for ground signs too close (sign B1 - B2 west), (code requires 200', <br />applicant shows 0'), section (1163.26 (A)). <br />Which is in violation of 90-125, Sections (1163.26 (A)) and (1163.26 (C)). <br />The variances granted are contingent upon future wall signs being closest to code as possible and <br />that no further requests for ground signs are allowed on the property/site. W. Kremzar seconded <br />the motion, roll call on the motion, J. Maloney, W. Kremzar, T. Kelly "yes", M. Diver <br />"abstained", and N. Sergi "no". Variances Granted as amended 6/2/05. Kremzar moved to grant Manoj Parikh of 24944 Deerfield Drive his request for variance <br />(1123.12) which consists of an addition and that the following variances are granted: <br />• A special permit to add to a non-conforming building (1165.02). Note: The existing rear <br />setback is only 35', code requires 50'. <br />l. A 28 foot variance for a residence too close to rear property line, (code requires 50', applicant <br />shows 22'). <br />Which is in violation of 90-125, Section (1135.08 (A)). J. Maloney seconded the motion. <br />In the framing of the motion; Mrs. Diver stated that she would defer her vote until she received <br />the engineering department's second report.
