CITY OF NORTH OLMSTED <br />BOARD OF BUILDING CODE APPEALS <br />COUNCIL CHAMBERS <br />THURSDAY, JULY 21, 2005 <br />MINUTES <br />1. ROLL CALL: <br />Acting Chairman M. Conway called the meeting to order at 5:30 p.m. . <br />PRESENT: Acting Chairman M. Conway; Board members N. Althen, D. Sabo <br />ALSO PRESENT: Building Commissioner D. Conway, Planning Secretary L. McNabb <br />ABSENT: Board members: R. Puzzitiello, P. Engoglia <br />II. REVIEW AND CORRECTIONS OF MINUTES <br />N. Althen moved to approve the minutes of June 16, 2005 as written. M. Conway <br />seconded the motion, which was unanimously approved. <br />III. OLD BUSINESS <br />IV. NEW BUSINESS <br />Andrew J. Szaniszlo, 27319 Benwood Circle, (WRD 11: <br />Proposal consists of erecting a fence along a property line where an existing fence has <br />been previously installed. This is in violation of 1369.03 (3). Note: Cannot erect a fence <br />along a property line where a fence already exists. <br />Mr. Szaniszlo requested to be allowed to place a fence next to his neighbor's existing <br />fence. He is requesting the fence for the safety/security; tranquility and for the overall <br />quality of life improvement. The fence would eliminate easy access to his yard and <br />resources in his yard. The Board was provided additional drawings of the applicant's <br />yard. <br />Mr. Conway inquired if the applicant had contacted his neighbor and see if he would be <br />willing to take down his fence. Mr. Szaniszlo had not thought about talking with his <br />neighbor, but would try. He reviewed his plans which proposed a 2 foot area between <br />his neighbor's existing fence and his proposed fence. Board members suggested a 3 foot <br />minimum distance between the fences. Mr. Szaniszlo indicated that the neighbors <br />existing fence is 1 foot inward from the rear property, and he proposes to be 2 feet in <br />from his property line which would equal the suggested 3 foot distance. He questioned <br />why Building Inspector Dave Peltz did not advise him the Board would require a 3 foot <br />space between the fences. Building Commissioner Conway advised the applicant that <br />although the code does not allow fences to be paxallel, on occasions the board has <br />allowed such requests with the stipulation that there is a 3 foot space between the two to <br />maintain tfie area.
