Mr. Szaniszlo proposed a 3%z foot gate in the fence to allow enough room for <br />maintenance. He suggested that he has been maintaining the neighbor's 1 foot area for <br />30 years. Ms. Sabo commented that if a variance was granted to allow the fence to be 2 <br />feet from the property line and the neighbor moves in the future, it could be possible that <br />new owners could say they do not want anyone on their property to maintain the area. , <br />Mr. Conway again asked Mr. Szaniszlo if he could talk with his neighbor about removing <br />his fence. Mr. Szaniszlo said he would speak to his neighbor. The Board advised the <br />applicant that the fence could be placed on the property line. Ms. Sabo questioned if the <br />applicant anticipates an issue with the neighbor not agreeing to allow his fence being <br />removed. Mr. Szaniszlo indicated his neighbor is somewhat difficult. <br />Building Commissioner Conway informed the applicant that the Board is looking for <br />additional factual evidence that his neighbor will not cooperate with him. Ms. Sabo told <br />Mr. Szaniszlo that he must show the Board why he cannot comply with the requirement. <br />The applicant was instructed to have a face to face conversation with his neighbor asking <br />him for permission to remove his fence and install the proposed fence. He was asked to <br />follow up the conversation with a certified letter asking the neighbor for his signature as <br />well as the results of the conversation. He will submit a copy of the letter to the Board <br />for their review. ' <br />D. Sabo tabled this proposal until the August 18th° 2005 meeting. N.
