On May 18th, the Assistant Law Director, Assistant Building Commissioner and the Planning <br />Director met with Mr. Halleen, his architect and legal counsel regarding the proposal. City staff <br />made several recommendations, including: <br />• Show the site plan for the entire development area, not just the new portion <br />• Eliminate the entrance from Dewey; consider second entrance onto Lorain if necessary <br />• Increase the buffering adjacent to residential parcels on north property line <br />• Increase the buffering adjacent to Dewey <br />• Provide greater buffering around the perimeter of the residentially zoned parcel to include <br />low mounding, landscaping, and/or fencing <br />• Bring lighting into code regarding pole height and illumination levels <br />Revised plans have been submitted and still require nine variances. One variance (Dewey <br />parking setback) has been somewhat reduced and one variance (lighting distance from residential <br />property) has been increased. <br />The revisions do show some indication of the layout of the remainder of the site. Ten feet of <br />grassed area has been provided around three sides of the residential parcel. Otherwise, no <br />significant changes have been made based on staff recommendation and no variances have been <br />eliminated. <br />Because of the nature of the variances requested and their potential impact on both the site and <br />landscape plan, Ms. Wenger recommends that the Planning Commission forward the applicant to <br />the Board of Zoning Appeals with recommendations, and that the applicant not be forwarded to <br />the Architectural Review Board until the outcome of the variance requests are known. <br />Asst. Building Commissioner Rymarczyk read the following variances that are requested: <br />1) A use variance for allowing parking & storage of vehicles for a car dealership on <br />residentially zoned land <br />2) A 13 foot variance for parking setback along Lorain Road <br />3) A 5 foot variance for parking setback along Dewey Road <br />4) A 10 foot variance for parking setback along north property line <br />5) A 68 foot variance for display of inerchandise in front setback (Lorain) <br />6) A variance for irrigation <br />7) A 5.04 foot candle variance for illumination level <br />8) A 98 foot variance for minimum distance from residential property of luminary based on <br />mounting height <br />9) A variance for light trespassing on other property <br />City Engineer Durbin had indicated that Ms. Becker wrote a letter to Mr. Halleen's architects <br />with 15 additional items addressing detailed improvement, utility, demolition and site plans that <br />will be needed. The radius of the drive on the north property line is too close and will have to be <br />moved south.
