Mr. Bohlmann voiced his concerns regarding <br />aboveground retention systems and past history of those systems which have not been properly <br />maintained. The commission stated new plans would need to be submitted to accurately state <br />that there would be a wet retention pond not a detention pond as stated on the plans. They did <br />not want any confusion as to what type of system was being used. <br />Mr. Bouman an abutting neighbor reviewed that in August the area was severely flooded and <br />residents were still dealing with the mess. Although the August rains were extreme from what <br />the area normally has the existing retention basin could not handle the water and flooded. <br />Although the proposed plan may help the existing problem somewhat it may not be large enough <br />to deal with the problems building the homes would create. He stated that he would do what <br />ever it took to stop the proposal until he is sure the City has done everything possible to deal <br />with the existing flooding problems of the area. Mr. Yager questioned if Mr. Bouman was trying <br />to say that the applicant should be made to fix other peoples water issues beyond the scope of <br />their development. Mr. Bouman stated that the applicant should not build in a flooding <br />neighborhood until he could make sure that the plan is adequate. Mrs. Hoff-Smith stated that if <br />anything the applicants plan would help the area and reminded Mr. Bouman that North Olmsted <br />had one of the strictest storm water codes in the nation and the proposal exceeded city codes and <br />would not add to the existing water problems. Mr. Bouman reiterated that he would keep the <br />project from being approved until.the residents did more studies. <br />Mr. Koeth asked Mr. Zwick if the proposed retention pond would be able to sufficiently handle <br />the development of the proposed homes. Mr. Zwick stated that the proposed pond exceeded <br />what is required by city codes for storm water retention. The placement of the pond was <br />strategically placed on the vacant Lorain Road property to be able to handle the water runoff of <br />the residential homes being constructed, but is designed to handle any future development of the <br />vacant Lorain property as well. Mr. Bohlmann advised that he was not against above ground <br />systems he is apposed to who in the long run would be maintaining them. He reviewed that the <br />system which Mr. Bouman referenced was in fact designed to empty into an aboveground <br />system, however it was a two phase project which unfortunately was never completed. Mr. <br />Koeth advised that the development would help the area and the applicant could not be held up <br />as the developer not only met but exceeded city requirements for water retention. <br />Ms. Kynion questioned what would happen to the woods behind her home and if the existing <br />water problems in the immediate area behind her home would be addressed. She questioned if <br />the trees would be saved as she purchased her home because she liked the woods along the back <br />of her property. Ms. Scebe the builder advised that a tree survey was completed and shQ would <br />not be entering the back 40-foot area of their land. There would be no reason for them to touch <br />the existing 40-foot drainage area. She assured the commission and neighbors that she would be <br />saving all the trees she possibly could. She had been building homes for more than 15 years and <br />it has always been important to her to save as many trees as possible. Mr. O'Malley advised the <br />commission to make the approval of the development contingent upon the tree survey being <br />followed. Mr. Yager reviewed that the applicants show a 40-foot buffer for the abutting <br />neighbors which exceeds city requirements. He suggested the city have the forester mark the <br />trees which are to be saved to ensure the trees are in fact saved. <br />R. Koeth moved to approve Vienna Woods Subdivisions No. 4 Subdivision Development <br />Plan (Salzburg Circle) PP# 231-28-017 thru 021 & 231-27-003, 21 & 084 thru 089 as <br />written with the following stipulations; 1). A double horizontal black aluminum fence is to <br />be placed around the retention pond, 2). The eovenant is to run with the land, wording and <br />10
