} CITY OF NORTH OLMSTED <br />CULTURAL ACTIVITIES COMMISSION <br />HELD AT OLD TOWN HALL <br />FEBRUARY 1, 2006 <br />MINUTES <br />I. ROLL CALL: <br />Chairman Garland called the meeting to order at 6:45 pm. <br />PRESENT: R. Garland, D. Wahl, F. Curry, B. Martindale, G. Yustick and B. Brown <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Historical Society President Angie <br />Cadwallader, Mr. Cdwallader, Historical Society member Paul Schumann, and Secretary to the <br />Kiwanis Club Glenn Knight. <br />The Commission observed a moment of silence on behalf of former Council member Carolyn <br />Kasler, Butternut School Principal Joan Bush and Officer James Calvitti whom passed away. <br />Mayor O'Grady was present to perform the reappointments of each of the Cultural Activities <br />Commissioners under their new staggered terms. He advised that Commissioner ponald Fraizer <br />resigned his position on the Cultural Activities Commission. <br />Mr. Garland questioned if by City Charter would Mr. Frazier's seat need to be filled by a school <br />board member. Mr. O'Grady advised that although he would prefer the seat be filled by a <br />representative of the schools it was not mandatory. He encouraged the commissioners to <br />recommend anyone they felt would be of an asset to the commission. <br />II. REVIEW AND CORRECTION OF MINUTES <br />The Cultural Activities Commission minutes dated January 4, 2006, have been submitted for <br />approval. <br />III. NEW BUSINESS: <br />Assistant Law Director Bryan O'Malley will be in attendance to answer questions pertaining to <br />proposed art show. <br />Mr. O'Malley reviewed that the flyer that was created was brought to his attention which raised <br />the question as to whether or not the commission should be in the business of sponsoring or <br />conducting an art shows. He reviewed that the North Olmsted Codified Code chapter 159.01 <br />clearly states that the commission shall not take control of any cultural events from a sponsoring <br />organization and shall not assume the financing of any events as the financing shall remain the <br />sole responsibility of the sponsoring organization, which shall assume any profit or loss. A good <br />example to follow would be the commissions roll supporting the Dover Players the commission <br />promotes, encourages and endorses their plays. They provide them a location to perform, <br />advertise for them, and assist them in setting dates. However, the commission does not sponsor <br />the activity. <br />He assured the commission it was not the goal of anyone to shut down the possibility of an art <br />show rather to encourage the commission to find a non-profit organization to sponsor the art <br />show. The commission could then support the sponsor by creating flyers and even finding the <br />place to have the show. Mr. Yustick questioned if all reference to North Olmsted Cultural <br />Activities Commission needed to be removed from the flyer. Mr. O'Malley advised that the only <br />wording which should be changed in the flyer is wording referencing who the sponsor is, or <br />where to send the applications and fees. The commission can help a sponsor find vendors, and <br />locations to hold events, even help advertise the event but that is all. The commission can even <br />volunteer to help at the event they just can not sponsor the event. <br />1
