Ms. Wenger said currently residential <br />homes in the axea are non-conforming, which could be a challenge to resale because of non- <br />conforming provisions. However under the new zoning owners can add onto their homes or <br />sell their homes for residential use or office uses. So the selling value would ultimately <br />depend on what use the land is being sold for. <br />J. Lasko moved to recommend Council adopt Ordinance No. 2006-164 which is an <br />ordinance providing for the amendment of the Zone Map of the City of North Olmsted <br />by rezoning permanent parcel numbers 233-06-001, 233-06-002, 233-06-0039 233-06-004, <br />233-06-005, 233-06-006, 233-06-007, 233-06-008, 233-06-009, 233-06-010, 233-06-011, <br />233-06-012, 233-06-015, 233-06-016, 233-06-017, 233-06-018, 233-06-019, 233-06- 020, <br />233-06-021, 233-07-002, 233-07-003, 233-07-009, 233-07-025, 233-07-028, 234-05-004 and <br />234-06-006, located in the Barton-Bradley Roads area, from their respective current <br />zoning classifications of limited industrial, miaced use single family residence and/or <br />multiple residence, some which are split-zoned, to the new residential office district <br />classification. R. Bohlmann seconded the motion which was unanimously approved. <br />Ms. Wenger advised the audience members that there would be a Council meeting regarding <br />the ordinance and notices would be sent out again by the clerk of council and placed in the <br />local newspaper. Mr. Lasko advised that the minutes would be forwarded to City Council as <br />their commission is only the first step in the review process. He also noted that members of <br />city council were present Mrs. Dailey-Jones and Mr. Barker both of which heard the concerns <br />and questions that were raised. <br />VI. COMMUNICATIONS: <br />• Ordinance No 2006-162: <br />An ordinance amending chapter 1118 of the Zoning Code in order to update and change the <br />procedure for granting and revoking conditional use permits. <br />Ms. Wenger reported that at the last meeting discussions covered the current conditional use <br />pertnit process and how recommended changes came about. As the city deals with different <br />types of developments and zoning districts the city struggles to try to find standards that deal <br />with all scenarios. Her recommendations were in conjunction with input from the zoning <br />advisory committee as to how the city could modify the conditional use permit requirements <br />in order to increase clarity, to address more types of uses and also include a revocation <br />procedure so that if it is determined that a conditional use permit was granted under <br />misinformation or conditions had changed, then the city could review the permit and in fact <br />give City Council the means to revoke a permit if needed. There were two recommended <br />changes from the last meeting which were added. The first, 1118.03(G)(9), was added to <br />ensure the Planning & Design Commission would not be limited in their ability to place <br />conditions on the permit. The second pertained to temporary structures and that has been <br />removed from the section. They should be more regulated in a section exclusively for <br />temporary structures, which she is now working on for the zoning committee to review. <br />Currently under the business sections of the codes there are provisions for developments that <br />want to have a temporary trailer while the construction is taking place'and doesn't go any <br />further than that. However she would like to see the regulations cover things such as <br />structures for holiday or seasonal events which take place and require temporary structures. <br />The chapter would be designed so that temporary structures could be handled <br />5
