J. Lasko moved to approve the proposal for Taco Bell of 24247 Lorafn Road, which <br />consists of demolishing the existing building and constructing a new restaurant with site <br />improvements, with the following conditions: <br />1) The elevations will be revised as shown on sheets A5 & A6 submittecl at the meetuigo <br />2) The Loxon panel system with the Coronado thin brick will be used at the site. <br />3) The top banding along the building will be the three color scheme as presentede <br />4) The Brickwood Clay color will be used on all towers. <br />5) No signage or other form of advertisement will be permitted in the expression panelse <br />6) New landscaping plans will be submitted in accordance to Mra Malone's requestse <br />7) The color of the vinyl fence is to be tana <br />R. Cin$ular Wireless; 6881 Barton 12oad: (WRD #4) <br />Proposal consists of locating a telecommunication antenna and site improvements, Note: Due <br />to time constraints PDC tabled the proposal on 04-26-06. Applicant will require varianceso <br />Ms. Wenger reported that the proposal consisted of locating an antenna on an existing utility <br />tower located within a CEI easement areao An equipment cabinet is located next to the tower. <br />The arrangement is ideal as the antennas blend into the existing conditions of the CEI <br />easement, better than most other areas witlun the City. However, the Zoning Code requires the <br />equipment shelter be screened with 15 feet of landscaping and specifies standards for an access <br />drive which the proposal does not meeta The site is accessed by a drive from Cook Road, <br />which would extend over a half mile to the tower. Safety Director Terbrack issued a memo <br />indicating his requirements for emergency access to the site which include a turnaround and a <br />bypass midway down the driveo <br />Mr. Rymarczyk advised that the applicants applied for a permitted use wireless communication <br />tower, equipment building and antenna to be placed on an existing tower. However upon <br />further review the applicants can request a conditional use permit rather than a permitted use. <br />As a conditional use the commission can wave many of the items requiring variances. He <br />requested the applicant disclose which way they would like to proceed. <br />Mr. Satarawala with Cingular Wireless, Mr. Midamba with Betel Corporation, and Mr. Graves, <br />the applicant's Attorney, were present to review the proposal. Mr. Satarawala advised that <br />Cingular purchased AT&T two years ago and at that time acquired their antennas. They are <br />now in the process of inerging the two antenna bands. AT&T inserted the power-tower in <br />February of 1997 alongside of CEI's public utility. There are currently 9 antennas on the <br />power-tower insert and inserts are only one per carrier. Cingular is asking for an additional 3 <br />antennas. Cingular will contain radio cabinets in a 12' x 20' radio shelter which is a state <br />approved industrialized unit. After their short meeting with Mr. O'Malley they have agreed to <br />move forward in accordance to chapter 1151.04. The three additional antennas will be <br />requested as a conditional use of an accessory use antenna under section 1151.04 subsections <br />(D2). He wanted to remind everyone that Cingular Wireless is a public utility and as such they <br />have a responsibility of maintaining wireless communications, and are moving forward as <br />required by the FCC to improve their service to their customer base. <br />The variance for lack of landscaping is due to CEI only allowing them a specified space around <br />the tower. The use of the tower is an easement only basis and the land is not owned by <br />Cingular. They do not have a problem landscaping but only the land which is owned by CEI, <br />otherwise the majority of the land is a utility easement placed upon the land owned by the state <br />and they can only use the easement area for ingress and egress to the tower.
