Ordinance No. 2006-008
An ordinance amending section 1135.02 of the zoning code in order to permit larger detached
accessory storage buildings on one family residence district lots that are one acre or greater in
size. Note: Planning & Design Commission tabled the ordinance 01/24/06.
Ms. Wenger advised that she was in favor of a tiered/table structure to regulate accessory
structures/sheds for larger lots. However she feels that the definitions for accessory structures,
sheds and garages should be better defined under definitions. Criteria standards for the size of
the structures should be clearly listed i.e. construction materials, foundation requirements, an.d
height limitations.
She recommended the commission approve the adoption of the ordinance with the following
recommendations:
1). Clearer definitions should be written detailed differentiating of garages, accessory structurPs
and sheds
3). A sliding scale minimally two categories of lots sizes for sheds be established
4). Structures/units housing vehicles be required to have a paved surface leading to the structure
5). Structures over a determined/specified size would be required to have a foundation
6). Number of accessory structures allowed on a lot clarified
7). Side and rear yard setbacks addressed
8). Landscaping and drainage requirements set and defined
Mr. Rymarczylc indicated that the code needed revising as to what is acceptable, as a garage is
not a shed nor is a pole barn a shed however the code does not clearly define any of them.
Commissioners questioned if they should be addressing the ordinance or should the Board of
Zoning Appeals. Ms. Wenger advised that it was the role of the Planning & Design Commission
to malce recommendations on zoning amendments.
J. Lasko moved to recommend Ordinance 2006-008 with the inclusion of the Planning
Director's recommendations prior to final approval. M. Mahoney seconded the motion.
Roll call: M. Meredith, M. Mahoney, J. Cotner, G. Malone, J. Lasko, R. Bohlmann - yes;
M. Yager - no. 1VIotion Passed.
VII.
