the legislation due to the current proposal nor should the commission base their outcomes on <br />legislation being addressed by City Council. <br />Mr. Newberry indicated that he was present to answer any questions and reviewed the variances <br />granted by the BZA. Regarding engineering issues, they will work with the Engineering <br />Department and will comply with all city engineering requirements. Mr. Pat Gareau and Mr. <br />Murtaugh, both with Catholic Charities, reviewed the many facilities Catholic Charities has <br />developed or co-developed and continue to oversee. <br />Mr. Bohlmann asked if the detention basin would drain into the existing St. Clarence detentian <br />system and questioned if the detention basin under St. Clarence was large enough to handle tYie <br />additional load. Mr. Newberry said it was and that this proposal will not adversely impact tYie <br />function of St. Clarence's existing basin/tank. Mr. Bohlmann questioned if the applicants wei°e <br />required to meet all current city engineering code requirements. Ms. Becker assured tYie <br />commission that the developer would have to meet all current city engineering codes. The <br />commission briefly reviewed past discussions pertaining to independent and assisted living ur,Lit <br />sizes as well as public space which is provided for all tenants. <br />Mrs. Meredith questioned if there would be any lighting provided for the carport area. Mr. <br />Newberry reviewed that although there would be no pole lights there would be lights under the <br />roof of the carport and would have minimal light spillage. Mr. Yager questioned if the small <br />louvers/vents shown on plans A-1 were in fact individual window unit vents. Mr. Newberry <br />advised that all past plans showed assisted living units having window units. There had been <br />discussions regarding whether or not the independent units would have window units or a central <br />HVAC systems but they have elected to install a central HVAC system throughout tlle <br />independent living units. <br />Mr. Yager believed that the building was what the city was looking for architecturally and would <br />virtually be maintenance free. It works well aesthetically and physically next to the church and <br />the applicants should be commended for their proposal. <br />Mr. Malone commended the applicants for their landscape design and materials chosen. <br />However he suggested that the proposed blue spruce trees along the west & east be planted 20- <br />feet apart on center instead of 12-feet, as well as the trees used in the front beds. The number of <br />proposed trees should not be reduced they should just be redistributed throughout the properi:y. <br />This spacing will allow for future growth and avoid crowding the trees as they grovv. <br />Intermittently plant a mixture of Stella d'Oro daylilies and a mixture of vinca minor/periwinlcle <br />in between the trees as well as in the proposed beds to add color variety. He recommended t:he <br />sidewalk be bumped out to the south or inward to the north to preserve the existing large whiite <br />oak tree as it is a specimen. He asked what would be done to protect the tree during aind <br />throughout construction. Mr. Newberry advised that the specifications would require the <br />contractor to barricade at the drip-line and to protect the tree at all costs as they are aware that: it <br />is a specimen. He further suggested that the owners may be willing to worlc something out wiith <br />the City to move the sidewalk inward to the north to assure the tree's survival. Mr. Conway <br />requested the applicants submit an updated landscape plans prior to going to BZD. <br />Mr. Kish, a neighbor, reiterated Mr. Bohlmann's concerns that the church which was built many <br />years ago and the basin may not be properly sized to handle the additional water flow. He urged <br />the city to require the applicant to submit a study showing the existing system can handle the <br />additional overflow. <br />2
