The proposed drive apron does not match that shown on the Ohio Department of Transportation <br />plans, but will affect the Lorain Road right of way area only, not the private property side of th.e <br />sidewalk. Detailed improvement plans need to be submitted to the Engineering Department for <br />review including a grading plan, erosion control plan, and construction details. <br />Mr. Boss advised that he provided what was asked for and he agreed with the school that a fenc,e <br />would not provide any safety. He complied with the additional landscaping and added trLe <br />enclosed concrete dumpster area and moved the ground sign. He believed that issues pertaining <br />to State requirements would be up to the State as he has no say in the matter. Ms. Wenger <br />advised that the only area affected is from the sidewalk to the street and did not feel that it woul.d <br />impact anything the commission could control. <br />The commission requested more information pertaining to the request for relief from the current <br />retention requirements. Ms. Becker suggested that the applicant was only required to ad(d <br />additional storage for the new buildings. Mr. Boss indicated that an additional 700 cubic feet <br />was required. He reviewed that when his proj ect was first approved and constructed the stonm <br />water system met all city requirements, however since then city requirements have changed arid <br />he is now required too dig up his parlcing lot and install a system which meets today's codes. His <br />engineers have advised him that the proposed rear parking lot could store 3,000 cubic feet uf <br />water so it exceeds the required 700 cubic feet now required. He advised that his entire lot is <br />sand and there is now concrete available that he will use which is pervious concrete and wnll <br />allow the water to drain right down through the gravel into the sand in a timely manner. His <br />current system which is a percolating system has never filled so much that it has had to empty <br />into the street connection. Mr. Boss stated that if the proposed system does not work he would <br />correct the system. <br />Mr. O'Malley advised that Council is who grants variances for storm water requireinents. <br />However the commission can make recommendations to council as to whether or not they feel <br />the variance is warranted but it is not required or mandated for approval. Although the applicant <br />met city requirements when his proposal was first approved and some issues are grandfathered, <br />variances and engineering requirements are not. <br />Mr. Yager believed that the lights were decorative and consistent with current decorative lighting <br />used at the site. He questioned why concrete walls were proposed for the dumpster enclosure <br />instead of brick to match the buildings. Mr. Boss indicated the concrete could be colored to <br />match the buildings and the limestone used once water blasted will appear as an aggregate <br />surface. Mr. Malone indicated that he supported the pines being replaced and the applicant <br />should use a combination of annuals and perennials throughout the front bed around the sign. <br />The commission asked Ms. Becker's opinion as it relates to the proposed request to use the <br />parlcing lot as the detention basin. Ms. Becker said she did not have a strong opinion one way or <br />the other. <br />J. Lasko moved to recommend that Council grant Boss Office Park of 28900 Lorain Road <br />the request for a variance or waiver pertaining to North Olmsted Codified Ordinance, <br />section 927.10, based upon coanments of the meeting and in relation to the percolating <br />system which has worked on the site from 1986 to present. R. Bohlmann seconded the <br />motion, which was unanimously approved. <br />4
