1. A 34 foot variance for a 6' privacy fence located in neighbors 50' setback on a corner lot, <br />(code requires 501, applicant shows 16'). <br />2. A 42 inch variance for fence higher than code allows on a corner lot, (code permits 30", <br />applicant shows 7211). 3. A variance for a fence within neighbors 50' setback less than 50% open, (code requires 50% <br />open, applicant shows solid). <br />Which is in violation of Ord. 90-125 section; (1135.02 (f2)). N. Sergi seconded the motion, <br />which was unanimously denied. Variances Denied <br />Mr. Masola asked what his options were and what would he have to do. Mr. O'Malley advised the <br />applicant that he may want to contact an attorney as neither he nor the board could advise him as to <br />what his recourses were. <br />3. Robert Briesath; 6023 Decker Rd: (WRD # 3) <br />Request for variance (1123.12). The proposal consists of a new shed. <br />The following variances are requested: <br />1. A 40 square foot variance for a shed larger than code allows, (code permits 120 sq ft, applicant <br />shows 160 sq ft). <br />2. A 2%Z foot variance for a shed higher than code allows, (code permits 9', applicant shows 11 %z `. <br />Which is in violation of Ord. 90-125 section; (1135.02 (D 1)). <br />Mr. Bri esath the owner came forward to be sworn in and address the request. Mr. Briesath. advised <br />that he needed the requested height due to his and his wife's height as both are over 6 feet tall. The <br />proposed shed is a kit which is a barn style shed to allow a storage area above in the rafters. He has <br />a lot of decoys which he needs to store in the shed as well as his ATV, what he is requesting is a 10' <br />x 16'. shed. Mr. Burke asked if the shed was a kit and who would be building the shed. Mr. Briesath <br />stated that a contractor would be installing the shed and it would be completed in one day. He <br />suggested that he sent letters to each of his neighbors whom had no objections to his request. Mrs. <br />Sergi asked if the lot measured 80' x 140'. Mr. Briesath advised that that was correct and the total <br />square footage was 1301 sq ft. Mrs. Diver felt that the height of the neighbor's garage would hide <br />the height of the shed but felt that the square footage was excessive. Mrs. Sergi voiced that she <br />agreed with Mrs. Diver as did the other board members. Mr. Maloney asked if the applicant would <br />be willing to amend his request to a 10' x 12' shed which would meet code. Mr. Burke asked if the <br />kit could be altered and if it could what was the applicant willing to change. Mr. Brisetath said that <br />he would be willing to construct a 10' x 12' shed but really needed the height. Board members did <br />not object to the height if the shed was a 10' x 12' shed. <br />N. Sergi moved to approve Robert Briesath of 6023 Decker Rd his request for variance <br />(1123.12), which consists of a new shed and that the following variance is granted as amended <br />and agreed too: 2. A 2%2 foot variance for a shed higher than code allows, (code permits 9', <br />applicant shows 11 %, which is in violation of Ord. 90-125 section;(1135.02 (D 1)). M. Diver <br />seconded the motion, which was unanimously approved. <br />4. Abedel & Muna Mustafa; 6167 Park Ridge Dr. (WRD # 3) <br />Request for variance (1123.12). The proposal consists of the addition of a family room. The <br />following variance is requested: <br />1. An 11.9 foot variance for a residence too close to the rear property line, (code requires 50', <br />applicant shows 38.1'), <br />Which is in violation of Ord. 90-125 section; (1135.08 (a)). <br />Ms. Mustafa the daughter of the owner, Mr. LaRussa the contractor and Mr. Bhnot a neighbor each <br />came forward to be sworn in and address the request. Ms. Mustafa passed out letters from her <br />family which stated that they had lived in North Olmsted for 20 years and due to the family size <br />growing additional room is needed. They would like to add a family room and a master bedroom to <br />4
