A variance for lighting being left on all night without reduction,(code requires 50% reduction, <br />applicant shows none), section (1161.12 (j)). <br />Which is in violation of Ord. 90-125 sections; (1139.08 (g)), (1139.14), (1161.12 (C)) and (1161.12 <br />(J))• <br />Mr. Grooms the Project Manager and Mr. Hartley the Architect each came forward to be sworn in <br />and address the request. Mr. Hartley advised that due to the volume of customers they need an <br />additional ATM drive-thru which would extend the canopy. The addition would eliminate 11 <br />parking spaces which would provide a bypass lane. All building materials including colors would <br />match the existing building. Mr. Maloney advised that the third variance #3 for irrigation was <br />eliminated. Board members voiced that they understood why the variances were needed. The <br />additional lane is to accommodate the traffic at the drive up teller. The parking will still meet what <br />is required by code. Mrs. Sergi went through special permit findings and found that the addition and <br />use of the addition fit the area. The addition would help alleviate traffic issues on the site. The <br />board read through each special permit condition and felt that there were no objections to the special <br />permit. Mr. Maloney questioned the proposed lighting. Mr. Hartley advised that the photometric <br />shows only one area at the ATM machine which is above code and that is due to the ATM camera <br />which is needed for security reasons. If the lights are required to be turned off they could not <br />provide security for their clients and place clients in harms way. The light readings at the property <br />lines meet codes just the ATM area doesn't meet codes. <br />N. Sergi moved to grant Fifth Third Bank of 26187 Lorain Road their request for a special <br />permit to add to a non-conforming building section (1165.02 (b)(1)) as well as their request for <br />variance (1123.12), which consists of an additional ATM drive-through lane and that the <br />following variances are granted as amended: <br />1. A 17 foot 10 inch variance for rear yard setback, code requires 50', applicant shows 32'.21'), <br />section (1139.08 (g)). <br />2. A variance for conducting business activity in the rear yard, (code does not permit, <br />applicant sows business activity), section (1139.08 (g)). <br />4. A 17.8 foot candle variance for excessive illumination under canopy, (code requires 15 F.C., <br />applicant shows 32.8 fc.), section (1161.12 (C)). <br />5.
