by placing a storage shed in lieu of a garage. Mr. Burlce advised that the character of the <br />neighborhood was not conducive to a shed so large. Mr. Hogue reviewed that both his neighbors <br />have double garages and all he is asking for is a shed. He tried to malce an appointment with the <br />Building Commissioner and they came to his house instead. Mr. Maloney read aloud a letter from <br />Ms. Hostaclcy reviewing what was said at the June 1" meeting and how the applicant referred to his <br />proposed shed as a garage. She is against the request. Mr. Rymarczyk again advised that the <br />applicant could constnict a garage without having to go before the board. This would include a hard <br />stuface driveway. Mr. O'Malley advised that the applicant could resolve the issue by constructing a <br />garage. <br />J. 1Vlaloney moved to grant Linda Ann Hogue of 24261 Palm Drive their request for variance <br />(1123.12), which consists of a shed and that the following variance is granted: 1. A variance <br />for a shed larger than code allows, (code permits 80 sq ft, 8' high, applicant shows 300 sq ft 12' <br />high. Which is in violation of Ord. 90-125 section; (1135.02 (D1)). J. Burke seconded the <br />motion, which was unanimously denied. <br />3. Lldilco Kish; 3343 Walter Road: (WRD # 2) <br />The proposal consists of a special permit to add to a non-conforming building (1165.02). The <br />existing building is 46 feet from the right of way and code requires 50 feet. <br />Ms. Kish the owner caine forward to be sworn in and address the request. Ms. Kish reviewed that <br />she purchased the house a year earlier. She would lilce to place a front porch on the front of the <br />house to improve the appearance. Ms. Sergi aslced if the porch would be in line with the garage. <br />She felt that the porch would not create an adverse impact to the neighborhood, cause a nuisance, <br />nor create traffic issues. No variances are required and the neighborhood would only benefit from <br />the improvement of the home. Ms. Kish indicated that the porch would be even with the garage. <br />Board members each voiced that they had no objections to the request. <br />J. Burlce moved to grant I,ldilco Kish of 3343 Walter Road their request for a special permit to <br />add to a non-conforming building (1165.02). The existing building is 46 feet from the right of <br />wny and code requires 50 feet. M. Diver seconded the motion, which was unanimously <br />npproved. Special Permit Granted <br />4. Eric Gilham; 27079 Butternut Ridge Road: (WRI) # 3) <br />Request for variance (1123.12). The proposal consists of a new shed. <br />The following variance is requested: <br />l. A 5'/2 foot variance for storage shed higher than code allows, (code permits 10', applicant shows <br />15.5'). Which is in violation of Ord. 90-125 section; (1135.02 (D 1)). <br />Note: Landinarlcs granted the applicant a certificate of appropriateness on 06-12-06. <br />Mr. Gilham the owner came forward to be sworn in and address the request. Mr. Maloney read <br />aloud an e-mail from a Ms. Nelsen an abutting neighbor indicating she was un-able to attend the <br />meeting. She is concerned with the size, height and location of the shed being requested. She also <br />aslcs what would be stored in the garage and reviewed noise issues she has had with him in the past. <br />Mr. Gilham reviewed that the building would be on the southwest side of the property and he had <br />not had an outdoor pai-ty in a few years. The building is a pre-fabricated building and would be <br />painted the saine color as his home. Mrs. Sergi voiced that she had an objection to the size of the <br />shed due to the size of the lot however aslced if the height could be lowered. Mr. Gilham reviewed <br />that he is constructing the shed to loolc lilce a barn. Mr. Rymarczylc reviewed that if the height of the <br />shed is lowered it would alter the appearance of the shed and style which was approved by <br />? <br />J
