Diver moved to grant Eric Gilham of 27079 Butternut Ridge Road his request for variance <br />(1123.12), which consists of a new shed and that the following variance is granted: 1. A 5'/Z <br />foot variance for storage shed higher than code allows, (code perrrrits 10', applicant shows <br />15.5'). Which is in violation of Ord. 90-125 section; (1135.02 (D 1)). N. Sergi seconded the <br />motion, which was unanimously approved. <br />5. Francis Cool; 4627 Selhurst Road: (WRD # 1) <br />Request for variance (1123.12). The proposal consists of an above ground pool. <br />The following variance is requested: <br />1. A 189 square foot variance for above ground swimming pool, (code permits 1091 sq ft, applicant <br />shows 1280 sq ft). Which is in violation of Ord. 90-125 section; (1135.02 (d 2)). <br />Ms. Meszaros the daughter of the owner, Mr. Cool the owner, Ms. Anita Cool, Ms. Khoury both <br />daughters, Mr. Adainonis, and Ms. Merk neighbors each came forward to be sworn in and address <br />the request. Ms. Meszaros reviewed that she purchased the pool for her father. She tried to pull the <br />permit September of 2005 and was told that she could not pull the permit the contractor would have <br />to pull the perinit. She was only aware that the pool needed to be 5-feet from side yard and 10-feet <br />from the baclc property line but not aware you could not cover more than 20% of the rear yard. The <br />pool company finally applied for the permit however the pool was already delivered and is being <br />stored until the permit was issued. Her father and sister both have debilitating health issues and <br />needs the pool for exercising and the pool need to be sturdy. Mr. Cool reviewed that they had used <br />a blowi.tp pool but it is not sturdy enough for either him or his daughter. Ms. Merlc advised that she <br />has no objections to an above ground pool. Mr. Adamonis voiced that he had no objections to the <br />pool and voiced that the neighbors would good neighbors and everyone in the neighborhood gets <br />along. <br />N. The proposal consists of a sunroom addition. <br />The following variance is requested: <br />1. A 13 foot variance for a residence to close to the rear property line, (code requires 50', applicant <br />shows 37"). Which is in violation of Ord. 90-125 section; (1135.08 (A)). <br />Ms. Kuzila the owner and Mr. Nigel the contractor each came forward to be sworn in and address <br />the request. Mr. Nigel reviewed that his client would like a sunroom that would match the <br />neighbor's suruoom. Mrs. Sergi asked if playground and plastic sheds were counted in rear yard <br />coverage. Mr. Rymarczylc advised that playgrounds and plastic sheds are not calculated in the <br />coverage allowance. Mr. Nigel advised that the sunroom would be 12' x 16' and be a three season <br />room only. Part of the declc would be removed to install the sunroom. Board members voiced that <br />they did not thinlc the variance was substantial. It would not affect governmental services. It would <br />improve the character of the neighborhood and if the addition was any smaller it would not be <br />feasible. Mr. Burlce believed that the suruoom would enhance the property value. <br />4
