J. Maloney movecd to grant Maryann Schultz of 4176 Laurell Lane her request for variance <br />(1123.12), which consists of a sunroom addition and that the following variance is granted: <br />1. A 13 foot variance for a residence to close to the rear property line, (code requires 501, <br />aPPlicant shows 37"). Which is an violation of Ord. 90-125 section; (1135.08 (A)). J. Burlce <br />seconded the motion, which was unanimously approved. <br />IV. NON-RESIDENTIAL APPEALS AND REQUESTS: <br />1. Macy's Department Store; 100 Great Northern Mall: (WRD # 4) <br />Request for variance (1123.12). The proposal consists of new signs. <br />The following variances are required: <br />1. A variance for 2 additional wall signs on a unit, (code permits 1, applicant shows 3), section <br />(1163.27 (A)). <br />2. A 2.4 foot variance for a wall sign larger than code permits (north elevation (E01), (code <br />perinits 4', applicant shows 6.4'), section (1163.27 (C)). <br />3. A 2.4 foot variance for a wall sign larger than code permits (west elevation (E02), (code permits <br />4', applicant shows 6.4'), section (1163.27 (C)). <br />4. A 2.4 foot variance for a wall sign larger than code permits (south elevation (E05), (code permits <br />4', applicant shows 6.4'), section (1163.27 (C)). <br />5. A 51.7 square foot variance for a wall sign larger than code allows (north E01), (code permits <br />100 sq ft, applicant shows 151.7 sq ft), section (1163.27 (C)). <br />6. A 183.9 square foot variance for a teinporary sign larger than allowed, (west), (code permits 32 <br />sq ft, applicant shows 215.9 sq ft), section (1163.33 (D)). <br />11. A 183.9 square foot variance for a temporary sign larger than allowed, (south), (code permits 32 <br />sq ft, applicant shows 215.9 sq ft), section (1163.33 (D)). <br />12. A time variance for displaying (3) temporary signs, (north, west & south) (code permits 30 days, <br />applicant shows longer (see note #2), section (1163.33 (G)). <br />Which is in violation of Ord. 90-125 sections; (1163.27 (A)), (1163.27 (C)), (1163.24 (c)), (1163.33 <br />(D)) and (1163.33 (G)). Notes: #1. Includes 3 wall signs and 2 canopy signs. #2. Temporary signs <br />to be displayed after the installation of 3 permanent wall signs, until the national unveiling of new <br />signs. <br />Mr. Gainble, with Iinage Resource Group, Mr. Herbert with Kaufmanns, Mr. Berns Applicants <br />Attorney, and Mr. Preg, with Westfield Mall, each came forward to be sworn in and address the <br />request. Mr. Berns thanlced the board again for allowing them to return to address the signs. The <br />variances were significantly reduced and believed it worth noting his clients' efforts in worlcing with <br />the city. The 2 additional variances being requested will allow the applicant to have visibility to <br />traffic traveling thru and into the Mall. If the requested variances are granted the signs will be <br />consistent to or a little smaller than other tenants who have received larger variances in the past for <br />their signs. The timeframe for installing the signs is mid August and then to leave the temporary <br />signs up until Labor Day when they will have their national unveiling. Mr. Maloney suggested that <br />they would put an expiration dated for the temporary sign to be removed no later than mid <br />September.
