The proposal consists of an addition to house. <br />• A speciai permit to add to anon-conforming building (1I65.02). The existing house has a 40 <br />foot front yazd setback, code requires 50', section (1135.06 (A)). <br />'I'he following variance is requested: <br />1. A 2'/s foot variance for a house too close to rear properiy line, (code requires 50', applicant shows <br />47.5'). Which is in vialation of Ord. 90-125 section; (1135.08 (A)). <br />Mrs. 1Vluche the owner came forwazd to be sworn in and address the request. Mrs. Muche advised <br />that she has been in the home for 30 years and tlaey would like to enlarge the kitchen. They now <br />have grandchiidren and take care af her father who is in a wheelehair. They also need more space <br />to accomrnodate famiiy gatherings and make sure the home will accommodate her and her husband <br />in their later years. Mr. Burke aslced for clarification of the special permit beimg requested. Mr. <br />Conway advised tha# due ta the front setback of the home, the home is a lawfully non-conforming <br />building. The special permit would not be required if the owner did not reqtaire the 2?/z foot rear <br />yard variance. If the rear yard requirement of 50 feet was met the applicant woutd be allowed to <br />build the addition without going before the boazd. He advised that alffiough it is only a 2'/z foot area <br />but it would take qiaite a bit to redesign the addition to not require the 2'/2 foot variarice. Mrs. <br />1Vluche did uot believe that decreasing the adclataon by 2?/? €eet wottld be worth adding the addition. <br />The size of the addition is needed to allow for the wheelchair, fanuiy visitors and remain in the <br />home. Mr. Maloney asked if the fireplace is part of the addition. Mr. Conway advised that the <br />smoke stake for the fireplace is not in the ground and is not relevant to the request. He further <br />suggested that decreasing the size of the buitding dimensions would require redesigning the entire <br />addition. <br />J.
