Mr. Conway <br />advised that variances 14 & 15 are not required however a varianee # 17 is required in accordance to <br />chapter (1165.02 (d2)). Mr. O'Ma1ley advised that the non-confonning lot has a non-conforming <br />building a.ud as it stands currently it is grandfathered. However due to the fact that the non- <br />confornung structure is being reconsfiructed on the non-confoxming lot it requires a variance under <br />section (1165.02 (d2)). <br />Mr. Dugas advised that ttiey a.re in their first (1) year of a 20-year Iease and Taco Beil headquarters <br />requires that their buildings be either upda.ted or rebuilt every 20 years. In order to meet ADA <br />codes and other site requirements they have adjusted the location of the build'ang to the best of their <br />ability. The front yard setback which is requared today vvould be located in the middle of the <br />existing buiiding Iocation. The side yard setback is due to relocating the new buiiding close as <br />possible to the existing footprint and the drive-thru lane creates the variance. A variance for 2 <br />parking spaces is due to not having the ability to landbank parking due to the locaation of the <br />underground detention systezn. They feel that as their grimary business is the drive-thru 19 parking <br />spaces are adequate. T'here is not enough room on the Iot to accommodate an additionat 2 parking <br />spaces. Variance request #5 is needed due to reading a 1.9 fc reading along the rear property line. <br />Variance #7 the flight poles were lovvered to 18-feet with faall cut off fidares added which places the <br />closest liglit to the residentaal property line now at 60-feet thereby eliminating variaaiee #7. Variance <br />#9 is due to having two (2) wail signs on the same wall, #bey are allowed two wall signs as they are a <br />comer lot with fronta.ge on two streets but they are required to be placed one on each fronta.ge. <br />However they woanld like to have their logo (bell) and wording on the same wall. Variance # 10 is <br />not required as the bell was changed to a 4-foot height as required by code. Mr. O'Malley suggested <br />that if it is the intent of the appIicant to request permission to withdraw specific variances he should <br />just specify which variances he would like to withdraw. Mx. Dugas stated lhat he would like to <br />withdra.w the follovving variances: #5, #7, #10 and #16. The PDC arclutect requested that Variarnce <br />#11 be sought as he liked the bell floating above the building. Vaa°iances #12 & #13 are due to <br />ha.ving a grownd sign and a menu baard and the distance between them. Mr. O'Malley suggested <br />that if variance #9 is granted it should be conditioned that no other wall signs be allowed on the <br />building. <br />J.
