:.. <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />HELD IN COUNCIL CHAMBERS <br />MARCH 02, 2006 <br />MINUTES <br />1. ROLL CALL: <br />Chairman Maloney called the meeting to order at 7:40 pm. <br />PRESENT: Members: J. Maloney, M. Diver, J. Burke, N. Sergi and T. Kelly <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Assistant Building Commissioner T. <br />Rymarczyk, and Clerlc of Commissions D. Rote. <br />Chairman Maloney reviewed that there were 4 cases requesting 15 variances on the docket. He <br />further advised that each board member had viewed the premises involved for each case. Three votes <br />are required for approval and in addition, each case would be judged on the physical situation <br />peculiar to itself, so that in no way is a judgment rendered considered to be a general policy <br />judgment affecting properties and like situations elsewhere. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />N. Sergi motion to approve the Board of Zoning Appeals minutes dated February 2, 2005, as <br />written. M. Diver seconded the motion which was unanimously approved. <br />III. BUILDING DEPARTMENT REQUESTS: <br />OLD BUSINESS: <br />NEW BUSINESS: <br />1. Carol Schemrick; 25015 Arlington lane: (WRD 94) <br />Request for variance (1123.12). The proposal consists of a new shed. <br />The following variance is requested: <br />1. A 66 square foot variance for storage shed larger than code allows, (code permits 30 sq ft, <br />applicant shows 96 sq ft. <br />Which is in violation of Ord. 90-125 section (1135.02 (D1)). <br />Ms. Schemriclc the owner came forward to be sworn in and review the request. Board Member J. <br />Burlce excused himself from participating in the applicants request due to dealings with the applicant <br />in his private practice. Ms. Schemrick indicated that she recently purchased the home and has found <br />that there is not enough storage space. She does a lot of craft work and needs the additional storage <br />area. She could have installed a plastic shed but did not think it would do much to enhance the <br />neighborhood. Board members felt that the yard was already very small, crowded and the shed was <br />too large for the size of the yard. The home value is not affected by the shed, the size of the variance <br />is substantial and the neighborhood, would be adversely affected by the shed. Furthermore there are <br />other options available to the applicant. Mr. O'Malley advised that although the applicant was <br />entitled to a plastic/removable shed he was not sure that a large plastic/removable shed of the same <br />size would be allowed either. Ms. Schemriclc said she did not want a plastic shed or a smaller shed. <br />J. Maloney motion to approve Carol Schemrick of 25015, Arlington Lane her request for <br />variance (1123.12) which consists of a new shed and that the following variance is granted: <br />1. A 66 square foot variance for storage shed larger than code allows, (code permits 30 sq ft, <br />applicant shows 96 sq ft. Which is in violation of Ord. 90-125 section (1135.02 (D1)). M. Diver <br />seconded the motion, roll call on the motion; J. Burke "abstain", J. Maloney "yes", M. Diver, <br />N. Sergi and T. Kelly "no". Variance Denied
