2. Cort Furniture; 4698 Great Northern Blvd: (WRD #4) <br />Request for variance (1123.12). Proposal consists of erecting a 40' x 75" tent for a temporary tent <br />sale from 6/5/06 through 6/12/06 and 8/21/06 through 8/28/06. <br />The following variance is requested: <br />1. A variance for 20 car parking space reduction. <br />Which is in violation of Ord. 90-125 section (1161.05 (w)). <br />Mr. Cristino the Manager came forward to be sworn in and review the request. Mr. Cristino advised <br />that there would be no electricity in the tent and it is their annual event. Board members questioned <br />the dates requested as the owner's letter listed different dates than shown on the application. Mr. <br />Cristino reviewed that the tent would be set-up on June 5 and remain in place through June 12I' and <br />then again August 21 St through August 28t'. It requires two days prior to the actual date to get the <br />tent setup and merchandise in place, then time to take everything down once the sale ends. <br />N. Sergi motion to approve Court Furniture of 4698 Great Northern Blvd their request for <br />variance (1123.12), which consists of erecting a 40' x 75" tent for a temporary tent sale from <br />6/5/06 through 6/12/06 and 8/12/06 through 8/28/06 and that the following variance is granted <br />as amended: 1. A variance for 20 car parking space reduction. Which is in violation of Ord. <br />90-125 section (1161.05 (w)). T. Kelly seconded the motion, which unanimously approved. <br />Variance Granted <br />3. Tuesdav Morning; 24749 Lorain Road: (WRD # 4) <br />Request for variance (1123.12). The proposal consists of refacing a non-conforming sign. <br />The following variance is requested: <br />1. A variance to reface (change of use) non-conforming pole sign, (code does not permit, applicant <br />shows refaced) (see note #3). <br />Which is in violation of Ord. 90-125 section (1163.10 (c)). <br />Notes: <br />4 1. Use changed from (1139.3 (c)) Hardware, to (1139.3 (d)) gifts. <br />#2. Was for lease since September 1999. <br />#3. Sign was changed prior to permit & Board of Zoning Appeals application submission. <br />Mr. Frezel, representing Ace Lighting and Mr. Carter the Strip Center Owner each came forward to <br />be sworn in and review the request. Mrs. Sergi excused herself from participating in the applicant's <br />request. Mr. Frezel advised that his client was present to request the board allow him to keep the <br />existing sign which was put in place prior to receiving a permit. Mrs. Diver questioned if in fact the <br />use of the space had changed. Mr. Carter advised that the service/product of the space had changed <br />many times with each tenant but the use has always been retail. Mr. Burke asked who installed the <br />sign. Mr. Carter advised that the tenant asked him about signage and was advised to seek permits. <br />The board questioned why the lighting company installed the sign without permits. Mr. Frezel <br />advised he was hired by the owner to build the wall signs and while in the building department <br />pulling his permits he found out the pole sign was altered without a permit. Mr. O'Malley advised <br />that he was not sure that a variance was required and would like to research possible legal issues. <br />Mr. Burlce advised that he is firmly against any owner installing signs without proper permits. Mr. <br />Maloney advised that the board would like to table the issue until the Law Department makes a <br />determination. <br />John Maloney motion to table Tuesday Morning of 24749 Lorain Road until the law <br />Department renders a determination. M. Diver seconded the motion, roll call on the motion; <br />J. Maloney, M. Diver, J. Burke, T. Kelly, "yes" and N. Sergi "abstain". Request Tabled <br />2
