CITY OF NORTH OI.MSTED <br />BOARD OF ZONING APPEALS <br />JAIVUARY 12, 2006 <br />MINUTES <br />I. ROLL CALL: <br />Mr. Maloney called the meeting to order at 7:45 pm. <br />He introduced new board member Joseph Burke to everyone and welcomed him to the board. The board <br />reviewed their procedures with the new board member. <br />PRESENT: Chairman J. Maloney, M. Diver, J. Burke, T. Kelly and N. Sergi. <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Building Commissioner D. Conway, Planning <br />Director K. Wenger and Clerk of Commissions D. Rote. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />N. Sergi moved to elect John Maloney to serve as the boards 2006 Chairman. M. Diver seconded <br />the motion, which was unanimously approved. <br />N. Sergi moved to elect 1VIaureen Diver as Vice Chairwoman for 2006. J. Maloney seconded the <br />motion, which was unanimously approved. <br />M. Diver moved to approve the Board of Zoning Appeals minutes dated December 1, 2005, as <br />written. J. Burke seconded the motion, which was unanimously approved. <br />Chairman Maloney reviewed that there were 8 cases requesting 29 variances on the docket. He further <br />advised that each board member had viewed the premises involved for each case. Three votes are <br />required for approval and in addition, each case would be judged on the physical situation peculiar to <br />itself, so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and lilce situations elsewhere. <br />III. BUILI)ING DEPARTMENT REQUESTS: <br />OLD BUSINESS: <br />• Emerald Villalie; 30344 Lorain Road: (WRI) 3) <br />Request for variance (1123.12). The proposal consists of a new development. <br />The following variances are requested: <br />1. A 14.2 foot variance for building side yard setbaclc, (code requires 53', applicant shows 38.8'), <br />section (1138.05). <br />2. A 14.5 foot variance for a building front yard setbaclc, (code requires 75', applicant shows 60.5'), <br />(1138.05). <br />3. A variance for 30 dwelling unit smaller than code permits, (code requires 400 sq ft, applicant shows <br />(see note # 1), section (113 8.07). <br />4.
