ensure noise and odor issues are eliminated. Mrs. Meredith reminded everyone that under the <br />revised chapter the city has the right to revoke the applicants conditional use permit. Therefore <br />as long as the conditions are clearly spelled out it is then up to the applicants to do what ever it <br />takes to meet those conditions and if the conditions are not continuously met then PetSmart loses <br />their conditional use permit. <br />Mr. Rerko agreed that a performance specification should be set and then it's the applicants <br />responsibility to build to the specifications. He believed that the commission should hold them <br />to specific dBA levels, which he described. Sounds emanating from the roofline to the tenant to <br />the south will require some type of acoustic ceiling system installed to keep the noise levels from <br />penetrating the roofline. Concrete will absorb odors and he recommended using epoxy sealants <br />to eliminate odor absorption. The condition of odors not being allowed around the perimeter of <br />the building will address odor issues. Mrs. Meredith believed that no odor outdoor would be <br />hard to accomplish as dogs currently visit the site and the odor is minimal. There is a company <br />called 5 senses which sells equipment to perform odor studies about which she has forwarded <br />information to the building and safety departments. Mr. Rerlco said properly designed HVAC <br />systems can ensure zero odors indoor and outdoors using proper filters. The existing doors along <br />the east are for emergency use only they cannot be used for drop off or pickup purposes. Mr. <br />Laslco advised that the board would not address sign variances until scaled sign package <br />drawings are submitted. Mr. Malone advised that as there was not a vet on site a vet sign was <br />not warranted. Ms. Wenger strongly suggested the applicants decrease the number of signs and <br />eliminate any signs from their canopies as she would not support canopy signs. <br />Commissions andinks of chapter 1118 Conditional Use permit.• <br />(a) The use is physically and operationally compatible with surrounding uses. The use will not <br />involve uses or activities detrimental to any persons, property, or general welfare by reason <br />of excessive traffic, noise, smoke, fumes, glare, odor or other characteristic not permitted in <br />the zoning district due to the conditions listed in section G below. <br />(b) The use can accommodate the site consistent with design and conformance with all <br />development regulations of the district, as shown by using existing entrance only and animals <br />currently allowed on site. <br />(c) The use will not impede the normal and orderly development and improvement of the <br />surrounding property in the district. <br />(d) On-site and off-site traffic generation and circulation will not be adversely impact adjacent <br />uses or cause hazardous conditions for pedestrians or vehicles adjacent to the site as there is a <br />comparable use already in place. <br />(e) The use will be adequately served by public facilities and services including, but not limited <br />to, water, sewer, electric, streets, fire and police protection, storm drainage and public transit. <br />Applicants adequately showed that sewer system would not be adversely impacted. <br />( fl The Commission found that screening with fencing and/or landscaping was not applicable. <br />(g). Additional conditions imposed are as follows: <br />1. Decibel readings for front (north side) of building to be at 65 dBA <br />2. Decibel reading for back (south side) of building to be at 52 dBA <br />3. Decibel reading for the roof of the building to be at 65 dBA <br />4. Decibel reading for adjacent tenants as taken from tenant's side of wall are no higher than 20 <br />dBA, which includes the tenant along the east side of the alley <br />5. Existing east doors are for emergency egress only and no nuisance odors or noise around the <br />building and/or other tenants' space in accordance to chapter 1118A2. <br />6. There will be no outdoor animal activities at the site behind the south side of the building. <br />7. Once the building is constructed the facility is to be tested for odors and noise levels indoors <br />and outdoors on a request basis at PetSmart expense. <br />6
