construction and he is not sure the difference between the masonry block at the study and brick <br />currently at the North Olmsted site. However there will be full height exterior walls to deck with <br />sound-bat insulation in the metal stud walls which are typically 8" CMU structures. There will <br />be no windows at the North Olmsted PetHotel. Mr. Lee brought construction plans to the <br />podium which generated discussion pertaining to whether or not official building plans for the <br />current site were or should be submitted or not. It also brought the issue of whether or not the <br />commission had the ability to rule on the conditional use without addressing construction issues <br />at the same time as construction materials would/could affect the commission's fmdings. Mr. <br />Rerko commented that the conditional use would/should be based on the building materials that <br />are being used as odor and sounds are affected and controlled by the building materials. <br />Mr. Whiteaker said the HVAC system which is used to control odor is the same at all PetHotels <br />including those used to perform the Duke study. Therefore the North Olmsted facility will have <br />the same HVAC system which includes UV filtration filters which are like those found in <br />hospitals. Mr. O'Malley believed that the conditional use permit should be addressed with the <br />development plan not separated. Mr. Conway believed that there should be some preliminary <br />plan review as his inspections are based upon standard building codes which in the applicant's <br />case may require additional building materials over and above standard building code <br />requirements. His department will need specific design standards/guidelines provided to conduct <br />their inspections while construction is taking place as it would be futile to find out basic building <br />standards could not comply with odor and noise restrictions. Mr. Lee voiced his disagreements <br />with the law and building deparhnents comments and believed that the commission could act on <br />the conditional use permit. Ultimately council will determine whether or not they will allow the <br />use within the district with specific conditions. The issue then becomes will the building being <br />proposed meet the city's building codes which in themselves will not be enough and require <br />additional conditions imposed to ensure odor and sound levels are not exceeded. <br />Mr. Rerko said SDC ratings are available on any wall or roof surface material. SDC specifies <br />what the reduction of noise will be from inside through a wall or roof surface. Therefore if an <br />inside DBS reading of 98 lists sound levels of dogs barking and an SDC rating for the roof is <br />listed it would provide him the transfer noise levels to the outside of the roof. His main concern <br />is the existing roof surface which is a metal deck and is not designed to contain noise/sounds. <br />The adjacent tenants are also a concern. The doggy bins along the south east are close to the <br />neighboring tenant's wall which is currently not enough to ensure dogs barking will not be heard <br />throughout the day by those tenants. Mr. Whiteaker said that an additional 6 inch full height <br />frame wall with sound-bat insulation would be constructed to ensure the adjacent tenant does not <br />havenoise penetrating their wall. <br />Ms. Falk from the abutting condominiums is concerned with the manner in which the fecal <br />matter would be addressed. Existing issues with Best Buy, Home Depot and other stores not <br />controlling noise levels or delivery trucks at the site throughout the night was brought up. There <br />needs to be better policing of what is going on behind the strip-center. Ms. Wise voiced her <br />concern of noise and odor as the condo owners already have to deal with foul odors and <br />offensive noise levels from existing businesses. Mr. Whiteaker reviewed how fecal matter <br />would be collected and disposed of and the cleaning process of the hotel. <br />Mr. Lasko advised that existing tenants along the east abutting space (unit 49) will require that <br />part of the renovations include additional sound deadening materials to ensure the noises do not <br />penetrate the walls. Mr. O'Malley advised the commission is within their right to ask for <br />additional documentation as to how the building is being designed to satisfy their concerns.
