COMMUNICATIONS: <br />• Building Department report for June 2007 <br />• Ordinance No. 2007-103 <br />An ordinance amending sections 1115.06 and 1139.01 of the North Olmsted zoning code in <br />order to limit the location of correctional facilities to the city's general retail business district. <br />Ms. Wenger said the request is a referral from council and is an effort to control the placement of <br />correctional facilities. There are types of correctional facilities which could have a negative <br />impact in residential neighborhoods. The use should be allowed but limited through the <br />conditional use process. The ordinance allows the city to review each facility on a case by case <br />basis. Mr. O'Malley reviewed that Assistant Law Director Heyward prepared the ordinance to <br />protect and assist the city in controlling the facilities locations. Mr. Burns with the chamber of <br />commerce felt the retail district has the highest population density and traffic so that they could <br />put the general public at rislc and suggested the light industrial district be used. Mrs. Meredith <br />felt that due to the conditional use restrictions the city would have the ability to control the <br />location to ensure it is in a suitable spot. Mr. O'Malley reviewed that from a legal standpoint the <br />city can not restrict the use to a zoning district which would not provide feasible sites. Mr. <br />Laslco thought the comments were well taken and believed that if the location of the use was <br />outside a retail district it would defeat the nature of the facilities which is to integrate individuals <br />baclc into society. Ms. Wenger agreed that access to community services is better within the <br />general retail district. Mr. Burns was concerned that jails would locate in the retail district and <br />reiterated that he thought they should be in the industrial district. <br />Mr. Lasko moved, seconded by Ms.1VIeredith, to approve tlae adoption of ordinance 2007- <br />103, which was unanimously, approved 6-0. <br />Ms. Wenger reviewed that the OPC conference is November 9 and any commissioner wishing to <br />attend would need to submit their applications no later than October 10. <br />ADJOURNMENT: <br />Mr. Laslco moved, seconded by Mr. Malone, to excuse the absence of Mr. Bohlmann which was <br />unanimously approved, 6-0. <br />The meeting was adjourned at 10:40 p.m. <br />Jo J.
