w <br />fence should be installed along the east property line to replace the chainlink fence. The <br />commission wanted no vending machines outside the building and reduced window signage. Mrs. <br />Meredith requested any damaged existing brick be replaced and all graffiti along the east side be <br />removed. Benches, bike racks and trash receptacles should be shown on plans. Mr. Weiler with <br />Drug Mart said that they would address these issues. Mrs. Meredith voiced a concern that the <br />drive-through could endanger pedestrian traffic. The applicants did not believe that the drive- <br />through would increase the amount of traffic at the site currently and estimate only 5 vehicles an <br />hour at the most through the drive-through. <br />J. Lasko moved to table Drug Mart of 24485 Lorain Road so the following information can <br />be provided: <br />1). The architectural and landscaping recommendations are to be incorporated into a final <br />set of plans. <br />2). A sign package submitted so recommendations on possible variances can be made. <br />3). Applicants are to address existing damaged brick which needs to be fixed and graffiti is <br />to be removed from the east side of the building. <br />4). Commission requested applicants agreement to not have any vending machines outside <br />their tiuilding. . <br />5). Address east property line and existing chain link fence. <br />6). Window glazing and amount of window signage clarified. <br />R. Bohlmann seconded the motion, which was unanimously approved. <br />V. NEW BUSINESS: <br />1. Tattoo Faction LLC; 30584 Lorain Road: (WRD #) <br />Proposal consists of the determination of similar use for body piercing in the General Retail <br />Business District. <br />Ms. Wenger reported that a similar proposal by this applicant for determination of similar use <br />for a tattoo parlor was previously approved by the Planning and Design Commission and City <br />Council. <br />She reviewed Chapter 1123.10 for the standards which should be applied in the commission's <br />determination: <br />• Such use is not listed in any other classification of pernutted buildings or uses; <br />• Such use is more appropriate and conforms to the basic characteristics of the district in which <br />it is to be located than in any other district; <br />• Such use does not create dangers to health and safety, and does not create offensive noise, <br />vibration, dust, heat, smoke, odor, glare or other obj ectionable influences to an extent greater <br />than normally resulting from other uses permitted in the same district; and • Such use does not create traffic to a greater extent than the other uses permitted in the same <br />district. <br />Mr. O'Malley cautioned the commission to avoid discussions pertaining to their personal likes <br />and dislikes. The Ohio Revised Code tends to lump together tattooing and body piercing both of <br />which are subj ect to extensive regulations by the State of Ohio and County Health provisions. <br />They are a regulated licensed business and both are subject to all State licensing inspection laws. <br />The applicants are asking the commission if the use fits into the General Retail Business District. <br />Mr. Royer, the applicant's attorney, Mr. Wulff, the owner, and Ms. Zayas, the body piercing <br />professional, addressed the commission.
