<br />BOARD OF BUILDING CODE APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES FO1Z OCTOSER 18, 2007 <br />120LL CALL <br />Vice Chair Althen called the meeting to order at 5:35 p.m. in Council's Caucus room. <br />Present: Norman Althen, Robert Lipcsey, BJ Meder, Donna Sabo. <br />Absent: Michael Conway <br />Staff: Assistant Law Director Bryan O'Malley, Building Commissioner David Conway, Clerk of <br />Commissions Donna Rote <br />1tEVIEW AND CORRECTION OF MINUTES <br />Mr. Meder moved, seconded by Mr. Althen, to approve the Board of Building Code <br />Appeals minutes dated May 17, 2007 as written, which was unanimously, approved 4-0. <br />OLD BUSINESS <br />NEW BUSINESS <br />Dave & Debbie Coe; 6257 Somerset Oval: (Ward 4) <br />Proposal consists of erecting a 4' high fence. <br />The following variance is requested: <br />1. A variance to install a 96 %z' foot section of 4' high board on board fence 10' away from <br />neigllvors existing 4' high chainlink fence which is in violation of section (1369.03 (a 3)). <br />Note: There is an existing 10' drainage easement between the existing and proposed fences. <br />Mr. Alfhen aslced if there would be a gate installed for access to the 10 foot area. Mrs. Coe <br />advised tliat there would be a 48" gate installed to ensure the area could be properly maintained. <br />Board members had no objections as the area included utility boxes and a 10 foot drainage swell. <br />Building Coinmissioner Conway advised that fences are not allowed in drainage swells/ditches <br />and it is his intent to address the matter when the zoning code is being updated. Therefore the <br />owner can not legally install a fence at his property line. The fence must be installed outside the <br />swell therefore it is reasonable in circumstances such as this to have a fence on either side of a <br />drairiage swell/ditch. <br />Mr. Althen moved, seconded by Mr. Lipcsey, to approve Dave & Debbie Coe of 6257 <br />Somerset Oval their request which consists of erecting a 4' high fence and the following <br />variance is granted: 1. A variance to install a 96 %Z' foot section of 4' high board on board <br />fence, with a 48" gate, 10' away from the neighbors existing 4' high chainlink femce, which <br />is in, violation of section (1369.03 (a 3)) and was unanimously approved 4-0. <br />Ron &z Yvonne Nagy; 4201 Tallwood Dr.: (Ward 1) <br />Proposal consists of erecting a 6' high board on board fence. <br />The following variance is requested: <br />1
