A. variance to install a 56 foot section of 6' high board on board fence 3' away from neighbors <br />existing split-rail fence which is in violation of section (1369.03 (a 3)). <br />Mr. Althen questioned if the applicant had discussed the installation of the fence with his <br />neighbor or if the neighbor was present. Mr. Nagy submitted a letter he received from his <br />neighbor (Mr. & Mrs. Timothy Parlcer) stating they would remove their 20 year old split-rail <br />fence prior to him installing his 6' high board on board fence. Board members advised that as <br />the split rail fence was being removed no variance was required therefore the request was <br />withdrawn. <br />Earl & Dianne Rhodes; 23465 David Drive: (Ward 4) <br />Proposal consists of erecting a 6' high vinyl fence. <br />The following variance is requested: <br />l. A variance to install a 22 foot section of 6' high vinyl fence 5' away from neighbors existing <br />6' higli fence which is in violation of section (1369.03 (a 3)). <br />Mr. Althen questioned if the proposed fence would mimic the neighbors fence. Mr. Rhodes said <br />the fence would not be the same style. There is a drop off along the rear area of their yard which <br />they would lilce to block off for safety reasons. There will be a gate installed for access and the <br />area will first be cleaned out gravel stones installed with a retaining system along the <br />embanlcment to minimize erosion. The abutting neighbors left side is open for access as well as <br />the proposed gate so the area can be maintained. Mr. Crystal the applicant's rear neighbor <br />voiced that he was concerned that due to the 2'/z foot grade difference between the homes the <br />proposed 6 foot fence height would be more like an 8%z foot wall. He also voiced a concern of <br />the vacated area being maintained. Mr. Conway advised that the owner would be responsible to <br />maintain the 5 foot area as well as any future owners. The 6 foot height of the proposed fence is <br />allowed by code and is not an issue before the board. Mr. Meder voiced that the area should be <br />easier to maintain as the evergreens were removed and the retaining system is being installed. <br />Mr. Coriway questioned if a weed block material would be installed below the gravel to control <br />erosion. Mr. Rhodes answered yes. Mr. O'Malley reviewed the boards roll regarding their <br />guidelines for the boards review process. Mr. Conway asked if there would be any grading <br />changes. Mr. Rhodes said there would be no grading changes made to the yard. Mrs. Sabo <br />suggested that the style of fence being installed would not be as high as the neighbor thought due <br />to the style of the fence, the top of the fence will be scalloped and varying in height from 5-6 feet <br />across each section. Mr. Crystal said the owners maintained their yard well his concern is for <br />firture . owners. Mr. Lipcsey reiterated Mr. Conway's comments that any owner would be <br />required to maintain the axea and if it is not then the neighbor could call the city to have an <br />inspector address matter. <br />Mr. Althen moved, Mrs. Sabo seconded the motion , to approve Earl & Dianne I2hodes of <br />23465 David Drive their request which consists of erecting a 6' high vinyl fence and the <br />following variance is granted: 1.
