A 360 sq ft overhang <br />added to south side of existing garage without a permit and existing garage is 864 sq ft, per <br />variance granted 4/99. <br />• A variance for section (1165.02) as the addition does not comply with side and rear <br />setbacks. <br />His request for variance (1123.12) which consists of garage additions and the following <br />variances as written: <br />1. A 594 square foot variance for a detached garage addition larger than code allows, (code <br />permits 750 sq ft, applicant shows 1344 sq ft), section (11135.02 (C1)). (Note 1) <br />2. A 5 foot sideyard variance for a detached garage addition too close to sideyard property <br />line, (code requires 51, applicant shows 01), section (1135.02 (C2)). (Note 2) <br />3. A 10 foot rear yard variance for a detached garage addition too close to rear property line, <br />(code requires 10', applicant shows 01), section (1135.02; (C2)). <br />4. A 9.9% and/or 462 square foot variance for total rear yard coverage, (code permits 20% <br />and/or 931 sq ft, applicant shows 29.9% and/or 1393 sq.,ft), section (1135.02 (D3)). <br />5. A variance for no access driveway to garage addition, (code requires access drive, applicant <br />shows none), section (1161.11). <br />Which is in violation of Ord. 90-125 sections (1135.02 (C1)), (1135.02 (C2)), (1135.02 (D5)) and <br />(1135.02 (D3)), which was unanimously denied 4-0. Mr. Goulding questioned what his options <br />were once denied and Mr. O'Malley advised him that it was not the boards place to give applicants <br />legal guidance. <br />NON-RESIDENTIAL APPEALS AND REQUESTS: <br />COMS07-0016: Clark Gas Station; 28925 Lorain Road: (Ward 3) <br />• Reconsideration of the denial of a special permit to add to a non-conforming building <br />(1165.02). <br />• Reconsideration of the denial of a variance for section (1165.02) as the addition does not <br />comply with front and rear setbacks. <br />• Reconsideration of the denial of various area variances of the BZA meeting of 10-04-07. <br />Mrs. Diver noted that a memo was received earlier in the day from the applicant requesting their <br />case be tabled. <br />All board members voiced that they would prefer complete plans with a proper write-up prior to <br />the night of their meeting to ensure the case is addressed properly. <br />Mrs. Sergi moved seconded by Mr. Menser to grant COMS07-0016: Clark Gas Station of <br />28925 Lorain Road their request to be tabled which was unanimously approved 4-0. <br />Blue Star Recvcle; 28820 Lorain Road (Ward 1) <br />The proposal consists of a use variance. <br />The following variance is requested: A variance too section 1139.01 to allow/permit a collection <br />center for recyclables. ? <br />Mr. Ivancic the Vice President and Mr. Altfeld President of Blue Star Recycling each came <br />forward to be sworn in and address the board.
