<br />in North Olmsted as shown in the plans submitted. Their company has been in business since <br />1883 in Elyria Ohio. In the last 18 months they have focused their business on residential <br />recycling. The building is designed so that customers can drive through the building and drop <br />off their recyclables be paid and leave. They accept aluminum cans, aluminum siding, all copper <br />products and other metallic materials. The process is a very clean quite collection point only <br />there is no processing at the site. All materials accepted are taken back to Elyria for processing. <br />The building structure, style and colors will match the existing building in Elyria it just wont <br />process any material. The benefits of their business for North Olmsted will be to provide an <br />alternative to the residents waste stream, minimize the flow of materials to the landfills, conserve <br />natural recourses, provide proper disposal methods, provide a, financial sensitive to recycle and <br />fund raising opportunities for schools and other groups. The business is an example for other <br />communities, is a clean business, generates tax's, maintains property values and is a potential for <br />partnership by providing household hazard waste collection drives. At this point they do not <br />accept hazardous waste material but could work with the city to arrange specific drives. Traffic <br />patterns would be less than the Aqua wash next door. In Elyria they average 50 cars total a day. <br />There will be no containers outside the building other tlian the BFI dumpster. Hours of <br />operations in Elyria are Monday through Friday 8:00 am through 4:30 pm and Saturdays 9:00 am <br />to Noon however if North Olmsted needs are different they could adjust their hours. They are <br />not open evenings, holidays or Sundays. , <br />Mr. Conway noted that he had not heard any discussion that the business should be permitted in <br />the proposed location. Furthermore he believed that the subject should be handled in a different <br />manor, possibly through the amending zoning codes. <br />Mr. O'Malley advised that the board needed to address the 'request as a use variance and the <br />standards are not flexible as to what factors are to be met. The applicant's have an absolute <br />burden to prove the three requirements of section 1123.12 exists in order to be permitted. They <br />must show the use should be allowed within the district they are requesting to go. What the <br />applicant has presented does not address any of the standards-they are asking relief from. The <br />three factors must be unequivocally proven or the request must be denied. <br />Mrs. Sergi voiced that she believed that the business was a welcomed concept but the request as <br />made did not show any hardships or address the three factors. Board members all agreed that <br />although they would like to see the business as described in North Olmsted a use variance could <br />not be granted following chapter 1123.12 (a). Mrs. Diver -voiced that the board hoped the <br />applicants continued to work with the city to bring their business to North Olmsted. <br />Mr. Menser moved seconded by Mrs. Sergi to grant Blue Star Recycle of 28820 Lorain <br />Road their request which consists of a use variance as written which was unanimously <br />denied. ` <br />COMS07-0028: Ml Realtv LLC.; 28300 Lorain Road (Ward 1) <br />Request for variance (1123.12). The proposal consists of signage and the following variances <br />are required: <br />1. A variance for 1 additional wall sign on a building, (co'de permits 1, applicant shows 2), <br />section (1163.27 (A)). <br />2. A 1.5 foot variance for a wall sign higher than allowed, (code permits 4', applicant shows <br />5.5'), section (1163.27 (C)) (see note). <br />Which is in violation of Ord. 90-125 section (1163.27 (A)) and (1163.27 (C)). <br />4
