Michael Boukzam of 4117 Cla2ue Roacl: area variance clenied: <br />A 10 foot sideyard variance for a garage too close to side yard on a corner lot, (code requires 25', <br />applicant shows 15'), section (1135.06 (B)). <br />The- property can yield a reasonable return without the variance. The variance denied was <br />substantial. The character of the neighborhood would be altered as the size of the garage loolcs <br />and equals the size of a second house. The applicant purchased the property with the knowledge <br />of the zoning restrictions as he said he spoke to the Building Cominissioner prior to purchasing <br />the home. Governmental services would not be altered or affected. The owner's predicament <br />can be precluded through another method the garage can be placed to code. The spirit and intent <br />of the zoning requirements would not be observed nor justice done granting the variance. <br />#3). Michael Boukzam of 4117 Claijue Road: Special permit to add to non-conforming buildin2 <br />The public peace, health, safety, morals, welfare or convenience would not be jeopardized. <br />The use, value, development or enjoyment of neighboring property would not be adversely <br />affected. Public or private nuisance would not be created by noise, smoke, odors, fire, <br />vibrations, objectionable lights or congestion of traffic. The home would not create traffic or <br />safety hazards. Board members did not feel that under section 1123.11 numbers 5 and 6 <br />would be affected by the request. <br />Mr. Burke did not feel that cases which are granted their request should have order of findings <br />only those which are denied. Brief discussions whether or not order of finding forms should be <br />created for each case or not took place as well as when the findings should be addressed during <br />the boards monthly meetings. <br />VI. COMMUNICATIONS: <br />Building Department Report February 2007 <br />Letter of resignation from Chairman J. Burke <br />An appeal to the Cuyahoga County Court of Common Pleas by Leslie A. & Magdalena M. <br />Szarlca, Trustees was received <br />Mr. Burke said he is sad he is leaving and has enjoyed serving on the board. He will miss everyone <br />on the board and commended the board in their efforts in trying to be consistent and encouraged the <br />board members to continue their efforts. <br />VII.
