Mr. Burke felt that the findings form needed some improvements. Mr. Burke felt that the findings for <br />Szarka were consistent to the discussion of the meeting. Mrs. Sergi and Mrs. Diver voiced that they <br />agreed with Mr. Burke that the findings accurately reflected what was discussed at the May 26, 2007 <br />meeting: <br />N. Sergi moved to adopt the order of findings for Corso's/Szarka Trust, Lot Split Plat of 29691 <br />Lorain Road as written for the March 26, 2007 meeting. M. Diver seconded the motion, which <br />was unanimously approved. <br />Mr. Burke felt that the Citizen Bank findings were consistent to the commission's discussions. Mr. <br />O'Malley pointed out that Number 3 did not have affirmative or negative underlined and 7 had no <br />entries.i iJnder condition 1 the applicants consent is neither yes nor no and he believed the issues were <br />not addressed by the clerk as she needed further clarification from the board. Mr. Burke felt that not <br />underlining anything under no. 3 was accurate. The clerk advised the board that when compiling the <br />board's findings of the bank she used the minutes of March 26, 2007 as well due to Mr. Burke <br />incorporating the board's prior findings. Mr. Burke felt the board found that the spirit and intent of the <br />zoning code would not be observed by granting the variances. The clerk advised that condition 1 was <br />left blank for applicants consent as she only heard the applicant agree to the second condition and did <br />not respond to the first. <br />J. Burke moved to adopt the findings for Citizen Bank of 26777 Lorain Road as amended. R. <br />Menser seconded the motion, which was unanimously approved. <br />Mr. Burke and other board members were confused about the Ganley Honda findings. The clerk <br />clarified that the board both grant and denied the applicants area variances requested. Mr. Burke felt <br />that the? reason no. 3& 6 were left blank was that the board felt they were inapplicable. Therefore the <br />findings are accurate as submitted. Mrs. Sergi felt no. 5 had no comment as it is assumed that <br />everyone has knowledge of the law. <br />J. Burke moved to adopt findings for Ganley Honda of 25870 Lorain Road as submitted. N. <br />Sergi sec6nded the motion, which was unanimously approved. <br />Mr. Burke opened the discussion for the Walter Dentistry findings. Mr. O'Malley pointed out a <br />clerical error which listed the wrong section of the code and Mrs. Diver pointed out condition 2 should <br />read proposed not purposed. Mr. O'Malley reviewed unnecessary hardship and how it should be <br />addressed and applied for the board. Mr. Burke requested the clerk in the process of reviewing the <br />tapes of March 26, 2007 clarify the boards and applicants discussions pertaining to the three factors <br />and how they applied to the applicant's request. A brief discussion ensued pertaining to the board <br />rendering their findings as each case is addressed and in particular those which are denied. <br />N. Sergi moved to table flndings for Walter dentistry so the clerk can review the tape. J. Burke <br />seconded the motion which was unanimously approved. <br />N. Sergi moved to table the Board of Zoning Appeals minutes dated March 26, 2007. R. Menser <br />seconded the motion, which was unanimously approved. <br />V.
