A 20 foot variance for lot width zoning code requirements, (code requires 150 ft, applicant shows <br />130 ft). <br />Which is in violation of Ord. 90-125 section (1139.06) <br />Mr. Romp, the owner, Mr. Siperke, the CEO of Chiswick Breweries, and Mr. Cole the Manager of <br />Operations each came forward to be sworn in and address the request. Mr. Romp advised that he <br />believed the variances were for the use not meeting the square footage of the lot. The building will <br />now be used as a restaurant with brewery. The lot is a landlocked pie shape which has an easement <br />for parking spaces and ingress/egress. Mr. Siperke reviewed that it is a full restaurant with a <br />brewery for on site consumption. Mrs. Sergi felt that the restaurant would be a good use for the <br />building and believed that any business would not be able to meet the lot area requirements. Mrs. <br />Diver questioned if there was sufficient parking. Mr. Conway advised that the Planning & Design <br />Commission addressed parking for the entire plaza and more than enough parking is being provided. <br />Mr. O'Malley said the board only need address area variances pertaining to lot size dimensions <br />required for the restaurant and requested the board require the easements be submitted to the Law <br />Department for review in their motion. Mrs. Sergi asked what the hours of operations would be. <br />Mr. Cole advised that they would be open for lunch and dinner. Ms. Sergi believed that the <br />restaurant was a welcome addition which would not adversely affect the neighborhood. There <br />would not be a detriment to the area caused by the variances. Government services would not be an <br />issue. Mr. Burke felt that the spirit and intent of the code would be observed and a substantial <br />justice would be done by granting the variances. Board members did not believe the lot could be <br />used without variances due to the size and shape of the lot. <br />T. Kelly moved to grant Aviator Ale Works of 24581 Lorain Road their request for variance <br />(1123.12), which consists of a restaurant and the following variances, are granted as amended: <br />1. A.82 acre variance for lot area zoning code requirements, (code requires 1.5 acres applicant <br />shows 0.683). <br />2. A 20`foot variance for lot width zoning code requirements, (code requires 150 ft, applicant <br />shows 130 ft). <br />Which is in violation of Ord. 90-125 section (1139.06). The applicant is to submit a copy of the <br />cross aecess easement documents to the Law Department for review. M. Diver seconded the <br />motion; which was unanimously approved. <br />IV. REVIEW AND CORRECTION OF MINUTES: <br />• The minutes for March 26, 2007 are submitted for approval. <br />Mr. Burlce requested the clerk re-listen to the tapes of March 26, 2007 as he felt that the minutes <br />should xeflect who was specifically speaking when the members were addressing the 7 factors of each <br />case addressed. Mr. O'Malley reviewed that the clerk does not transcribe minutes verbatim but <br />summarizes the business of the board and the actions taken. If the board feels that the minutes and <br />findings accurately reflect what accrued then they should be adopted as submitted. However if the <br />board feels that the tapes should be reviewed to edit the minutes then the board can table their minutes <br />so the clerk can amend the minutes as requested. <br />Mr: Bu'rlce said he wanted the minutes tabled and the clerk to review the entire meeting again and <br />reflect who is doing the deliberating when the 7 factors are being addressed. <br />• Board Of Zoning Appeals Order Of Findings of March 26, 2007 <br />7
