CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />HELD IN COUNCIL CHAMBERS <br />MARCH 1, 2007 <br />MINUTES <br />I. ROLL CALL: <br />The meeting was called to order at 7:30 pm <br />PRESENT: Members; M. Diver, J. Burke, N. Sergi, T. Kelly and R. Menser. <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Building Commissioner D. Conway, Asst. <br />Building Commissioner R. Mathews and Clerk of Commissions D. Rote. <br />Chairman Burke reviewed that there were 4 cases requesting 5 variances on the docket. He further <br />advised that each board member had viewed the premises involved for each case. Three votes are <br />required for approval and in addition, each case would be judged on the physical situation peculiar to <br />itself, so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and like situations elsewhere. <br />II. REVIEW AND CORRECTION OF MINUTE5: <br />R. Menser moved to approve the Board of Zoning Appeals minutes dated February 01, 2007 as <br />written. M. Diver seconded the motion, which was unanimously approved. <br />III. RESIDENTIAL APPEALS AND REQUESTS: <br />Michael Wasilko, 4193 Brendan Lane: (WRD # 2) <br />Request for variance (1123.12). The proposal consists of a new shed and the following variances are <br />requested: <br />1. A 30 square foot variance for a shed larger than code allows, (code permits 80 square feet, <br />applicant shows 110 sq ft), section (1135.02 D1) (See note #1). <br />2. A 1/2 foot variance for storage shed higher than code allows, (code permits 8 ft, applicant shows 8 <br />1/2 ft), section (1135.02 D1). <br />Which is in violation of Ord. 90-125 section (1135.02 D1). <br />Note: #1. Construction on shed was started prior to permit application. BZA tabled 02/01/07. <br />Mr. Wasilko the owner came forward to be sworn in and address the request. He reviewed that he <br />would remove enough of the back of the shed making to have a 110 square foot shed. However he <br />thought he required a 1-foot variance for the height of the roof not %z inch as written as his roof <br />would be 9 feet high. Mr. Conway explained that the height of a roof is not measured from the roof <br />ridge-line but is taken at the mid-point of the gable. Therefore the applicant only required %z inch <br />variance. Mrs. Sergi thanked the applicant for decreasing the size of the shed and working with the <br />board to eliminate a variance and decreasing the size of those needed. All board members voiced <br />their appreciation. <br />N. Sergi moved to approve Michael Wasilko of 4193 Brendan Lane his request for variance <br />(1123.12), which consists of a new shed and the following variances are granted: <br />1.
