Ms. Wenger reviewed the Commission requested plan amendments including showing revised <br />parlcing-lot striping and additional handicapped accessible space by deli, showing outdoor tables <br />and chairs, tying in the downspout to the storm water drains, adding additional planters with <br />planting materials, and changing the angle of the concrete ramp to follow control joints. She <br />noted the Commission said no outdoor spealcers would be allowed. <br />Mr. Conway said numerous property maintenance violations were noted on the site. The latest <br />plan and actual layout do not agree on parlcing and a number of changes were noted. The site is <br />required to have 225 parlcing spaces (based on 6/1,000s fl and they have 226 if those that are under <br />9' are allowed. Loading zones and dumpster locations are not shown. The rear fire lane is being <br />used for deliveries, which is not permitted. Property maintenance issues include dilapidated fire <br />lane gates, Uoard on board and chain link fence repairs needed, removal of playground equipment, <br />maintaining side and rear landscaping, parking lot lighting and electrical issues pertaining to light <br />poles. He requested the owner be required to bring the site into conformance with the plans which <br />were approved in 1988 but did not believe the owner's issues would affect Slam Jams project. <br />Mr. Collins noted that the plan showed the downspout routed and pitched properly. Mr. O'Malley <br />said that while the tenant should not be penalized for the owner's non compliance the commission <br />can require the owner address the Building Department's findings prior to their client being <br />docketed to meet with council. <br />Mr. Crook confirmed the downspout being corrected, cuts moved west two columns for handicap <br />ramp, one additional handicap space added by deli and the tables and chairs shown on the site <br />plan. Six 24" terra cotta containers were chosen for the juniper plants requested and are located <br />inside the fencing. There will be three smolcing containers outside. He assured the commission <br />that the Building Department violations would be addressed but as they just received the <br />information there was not time to address them. Mr. Laslco said that owners should know if they <br />properly maintain their property without the building department pointing out their violations. <br />Mr. Bohlmann felt that correcting the violations should be a condition of approval. <br />Mrs. Wenger pointed out that the current plans did not reflect what was approved in 1988 and <br />cautioned the commission that their approval should not allow deviations from the approved plan <br />for the balance of the site. Mr. Conway suggested the commission could approve the Slam Jams <br />patio work with a supplementary site plan that will become an amendment to the 1988 site plan. <br />Mr. Laslco aslced if Mr. Dawes was present over the weekend as he received a communication <br />froin residents saying the baclc door was open all night and the noise leyel was high. Mr. Dawes <br />said the door was closed after 9:00 pm except for taking garbage out. The doors are sometimes <br />propped open during the day for better air circulation. Mr. Conway said that as the establishment <br />provides music, dancing and a pool hall, they are required to effectively confine noise to the <br />building; therefore the doors should never be open. <br />Mr. Malone said the plans were inconsistent as the wording says there are 6 planters, one view <br />shows seven planters and the other shows five planters. He requested seven planters be used as <br />well as an eighth planter along the east near the front door entrance. The 24" terra cotta <br />containers can be used and the plants should be upright junipers planted a minimum of 3 feet high.
