Mr. Rerko pointed out that the saw cuts shown on the plan were not lined up at control joints for the ramp near the door. Mr. Crook said the cuts would be made at control joints. Mrs. Meredith questioned if employees were propping the back door to smoke as upon her visiting the site she noted a pile of cigarette buts outside the baclc door. Mr. Dawes said he would malce sure employees were not congregating out back. Mr. Malone noted that although he is not in favor of smolcing areas at the front entrance of any business the applicant's circumstances warrants the patio so he can abide by the smolcing laws. Mrs. Meredith is concerned the outside patio will encourage more patrons outside and noise levels which are already an issue will increase. Mr. Lasko moved, seconded by Mr.1VIalone, to approve the proposal for COMS08-0008: Slarn Jams of 24108 Lorain Road with the following conditions: 1. Owner will bring site back to conformance with the 1988 plan with specific modifications as related to Slam Jams' plans stamped June 11, 2008. 2. Show seven 24-inch terra cotta planters plus one additional planter by east door. Planters will include upright juniper trees at a minimum of 3 feet in height. 3. The cuts requirecl for the ADA ramp will be made at the nearest control joint. 4. There are to be no speakers outside or positioned to provide sound outside and no doors will be propped open. 5. The landlord is to address the Building Department's findings prior to the applicant meeting with Council. Roll call: Laslco, Bohlmann, Malone, Rerko, Williamson - yes; 1Vleredith - no. Motion approved 5-1. Mrs. Meredith said she believes noise levels will become out of control.
