COMS08-0008: Slam Jams; 24108 Lorain Road: (Ward 2) <br />Representatives: Joe Khouri, Carnegie Management; Mr. Dawes, owner <br />Ms. Wenger reported that the proposal consisted of adding an outdoor patio addition to an <br />existing tenant space. The patio will Ue located outside of the main entrance, on an expanded <br />sidewallc area. It will be enclosed with a 3%z foot high decorative metal fence. Four planter <br />containers and three cigarette receptacles are proposed. The parking lot will be slightly modified <br />to maintain required drive aisles, resulting in the loss of one parking space. <br />Mr. Conway advised that the owner needed to submit a drawing addressing the portion of the lot <br />which was restriped froin what was previously approved so the commission could approve the <br />new striping layout. There are no parking issues however the commission can set limits. Mr. <br />Collins said the downspout drain as it currently exists is against code and is required to be tied <br />into a storm sewer collection system which he would like required for approval. <br />Mr. Khouri said he had been working with City staff to provide his tenant an outdoor patio. <br />They have tried to meet all the issues brought up at their meetings such as handicap parking, <br />ingress/egress, parking and ADA compliance. Due to the new smolcing restrictions it has caused <br />business to decline and the outdoor patio will provide his clientele a place to smolce. They are <br />working to lceep tenants at the center. There are currently no accommodations for the clients <br />which smolce. Mr. Dawes said to be competitive he has to have a patio to accommodate <br />smolcers. Since the law was enacted they have had a 33% decrease in business. The area <br />proposed would house 5 to 6 small tables. <br />Mr. Rerlco said since the smolcing ban was passed outdoor patios in the front of businesses have <br />been added and he is concerned that it will encourage smolcing. The city may want to require <br />smolcing areas to be screen from view. He aslced for clarification of the parlcing lot restriping. <br />Mr. Rerlco said the joint cut for the ramp should be squared at the control joint to avoid <br />maintenance issues. Mr. Malone agreed with Mr. Rerko and is against smolcing areas in front of <br />businesses, but he understands the predicament business owners are in. He recommends heavier <br />buffering so the patio is not as visible from the front. More planters need to be used a minimum <br />of 24 inch diameter planters large enough to sustain upright juniper evergreens to create a hedge. <br />Annuals and perennials can also be added for seasonal color. Mr. Khouri said they would place <br />the planters inside the fence for safety. Mrs. Meredith aslced if tables and service would be <br />provided outdoors or if they affect the parlcing requirements. Mr. Conway said he would prefer <br />the cormnission see these details on a set of plans prior to approval and stipulate the number of <br />tables and chairs to be allowed and the parking space striping shown. Mr. Rerlco said that he had <br />no objections to outdoor tables as the use is after normal business hours of the plaza and will not <br />impact existing parlcing. Mrs. Meredith said she is concerned the smoking area along the front of <br />the building would be a detriment to the other tenants. She aslced if the patio could be placed <br />behind the plaza. Neighbors present in the audience voiced their disapproval of having a patio in <br />the rear of the plaza. Mr. Laslco asked that an additional handicap space be provided for the deli. <br />Ms. Williamson felt having the patio would contain the smokers and keep them from wandering <br />throughout the plaza. Mr. Conway said the patio is to allow drinlcs to be taken outside when the <br />smolcers step out. Mr. O'Malley questioned if the patio would be closed in during winter
