business models are introduced. This amendment would permit such facilities in the commercial <br />zone, subject to various restrictions, including a distance limitation from residential property, <br />activities carried out entirely indoors, noise control, and building size limitation, as well as any <br />conditions associated with the conditional use permit review. <br />Mr. Bohlmann did not feel this use is appropriate in the retail district on Lorain Road and <br />believes such a facility should be in the industrial district. Mr. O'Malley said there are currently <br />collection bins on properties in the City and that creating standards for a permanent facility <br />would be an improvement to outdoor bins. Recent state business regulations have raised the bar <br />for second hand dealers and there are more requirements for security for such businesses. He <br />said the Commission could consider issues such as traffic, noise, and odors potentially generated <br />by the use. <br />Mr. Malone questioned if the ordinance would allow for outdoor recycling of yard waste etc. <br />Ms. Wenger stated that the ordinance would require everything to be indoors. Ms. Meredith <br />suggested a conditional use permit for the limited outdoor recycling in the industrial district. Mr. <br />Bohlmann noted that the building needs to be 200 feet from any residential property line. Mr. <br />Malone stated that it should not be so restricted when we are trying to encourage recycling. Mr. <br />Bohlmann stated that the odor will be an issue in a residential area. Ms. Wenger said the <br />conditional use process would allow greater controls and if the applicant violates the conditions, <br />the permit will be revoked. Mr. O'Malley said that the 200 foot rule works well, however if it is <br />increased it might be impossible to use most parcels on Lorain Road for that purpose. Mr. <br />O'Malley noted there is an excess of general retail zoning which is why the conditional use <br />might work best where there are not hierarchies of commercial zoning. It is designed for a drive <br />through to collect and a substantial volume of devices. Mr. Malone stated that business areas <br />such as this are self regulating and any adverse impact will meet resistance in the community. <br />Ms. Meredith moved, seconded by Mr. Malone, to recommend approving Ordinance 2008- <br />17 to City Council with comments that the recycling eollections center would be permitted <br />outright in limited industrial area, there would be a conditional use permit required in the <br />general retail district which vvould allow more discretion with what facility could be built <br />within areas near residential neighborhoods.
