1. A variance for light trespassing, code does not permit, applicant shows light trespassing, <br />section (1161.12 (C). <br />2. A variance for not having a full cut off fixture, code requires full cut off applicant shows 60% <br />cut off, section 1161.12 (d). <br />Mr. Paul Ponstingle with DNS Technologies and Mr. Joe Cieply with V X Services Project <br />Manager for Fifth Third each came forward to be sworn in and address the request. Mr. <br />Ponstingle said the bank would lilce to replace all the lot lighting as current bases and poles are <br />dilapidating fast. They have tried to match the photo readings currently on the site but can not <br />meet city codes. They have chosen baclclight-shields to keep the impingement of light closest to <br />the light pole itsel£ They could install lower fixtLires however safety is an issue as the site is a <br />banlc. Along the Brookparlc Road sidewallc there are no street lights, is fairly darlc and shielded <br />by landscaping which creates safety concerns. Mr. Cieply said a light pole had fallen and they <br />were luclcy no-one was harmed. They are trying to get the sight lighting changed as soon as <br />possiUle before any further incidents talce place. Mrs. Diver questioned the age of the light poles. <br />Mr. Ponstingle said they were in place when the banlc purchased the building. Mrs. Sergi <br />questioned if light variances were granted when the ATM was added to the baclc of the building <br />and asked for clarification of full cut-off shields and baclclight-shields. It was noted that a <br />variance for the canopy light was granted at that time the ATM was approved. Mr. Conway said <br />the type of shields reflect the recession of the fixture inside. A full cut-off will not allow baclc <br />bleeding of light and backlight-shields push light forward. He is not concerned with light <br />bleeding onto the sidewalks and street his concern is lighting bleeding onto abutting property <br />owner's lots. The applicants could design the site to meet city code however they would have to <br />install quite a few more lights which is unrealistic. The applicants are trying to replace existing <br />fixtures and trying to come as close as possible to meet code. His best light meder can not read <br />below .25 foot-candles and considers anything less negligible. All lighting has to shine <br />downward and the applicant wants to use baclclight-shields to ensure baclc glow doesn't take <br />place. Board members had no objections as long as there were no residential sites affected by <br />the lights. As the site is a banlc, lighting is warranted for customer safety. <br />Mrs. Sergi moved, seconded by Mrs. Bellido, to grant Fifth Third Bank of 26187 Lorain <br />Road the following variances; 1). A variance for light trespassing, code does not permit, <br />applicant shows light trespassing, section (1161.12 (C). 2).
