, •. <br />Board members felt that due to the entrance canopy the site warranted a second wall sign. Mr. <br />Menser agreed that the matter of a variable message display system should be addressed by <br />council. Ms. Rudolph thanked the owners for bringing their business to North Olmsted. <br />Although she understands the applicants concerns regarding ways to hold down advertisement <br />costs she agrees with the cities legal advise that the matter should be addressed by council. The <br />code should be looked at to ensure that it can adequately govern new sign technology. Mrs. <br />Bellido agreed that council needed to look at the sign code to ensure it is up to date with <br />technology. Mrs. Diver felt the property could continue to produce a reasonable return. <br />Governmental services would not be altered and zoning codes are presumed to be known by <br />owners when purchasing property. The predicament can be resolved without a variance by <br />installing a ground sign to meet code until council can address the issue. The spirit and intent of <br />the zoning requirement would be upheld granting a second wall sign however, it wouldn't be <br />upheld granting a variance for an electronic moving sign. She does not believe that the board is in <br />a position to give relief from section 1163.23 as the electronic portion of the ground sign is clearly <br />in violation of the code. Ms. Rudolph said the variance was substantial as it is electronic and <br />violates almost every standard within the section of the code. The owner can install a sign to code <br />and seek assistance through council to resolve the matter. Both Menser and Mrs. Bellido agreed <br />and felt the property could yield a reasonable return without the second variance. <br />Ms. ltudolph moved seconded by Mrs. Bellido, to grant Kaplan's Furniture of 24869 Lorain <br />ltoad a variance for 1 additional wall sign on a building, code permits 1, applicant shows 2, <br />section 1163.27 A which was approved 4-0. <br />Ms. Rudolph moved seconded by Mr. Menser, to grant Kaplan's Furniture of 24869 Lorain <br />Road a variance for an electronically changeable script ground sign (flashing), code does not <br />allow applicant shows flashing electronic sign, section 1163.23 which was unanimously <br />denied 4-0. <br />The Move-It Store; 26735 Brookpark Road Ext. (Ward 1) <br />Request for variance (1123.12). The proposal consists of a loss of 2 required parking spaces & <br />conducting a business activity in the required front yard setback. <br />The following variances are requested: <br />1. A variance for obstructing 2 parking spaces, code does not permit and applicant shows 2 which <br />is in violation of section 1161.03. <br />2. A 70 foot variance for conducting a business activity in the required front setback code <br />requires 75' applicant shows 5' which is in violation of section 1139.07 schedule. <br />Note: Prior to the meeting the applicant permanently withdrew theia- requests. <br />ADJOURNMENT <br />T?meeting was 'ourned at 10:00 pm. <br />1 <br />Maureen Diver, Chair <br />?On?na Rote, erk o Commissions <br />Approved: <br />
