-.. <br />BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MEETING MINUTE5 OF MARCH 6, 2008 <br />1ZOLL CALL <br />Chairwoman Diver called the meeting to order at 7:30 pm in Council Chambers. <br />Present: Maureen Diver, Jennifer Rudolph, Robert Menser, Nancy Sergi, Laura Bellido <br />Staf£ Assistant Law Director Bryan O'Malley, Building Commissioner David Conway, <br />Clerk of Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Mrs. Sergi requested the clerk re-listen to the PetSmart discussion so the discussion pertaining to <br />the east side man-door could be reflected in the minutes. <br />Mr. Menser moved, seconded by Ms. Rudolph, to approve the February 7, 2007 Board of <br />Zoning Appeals minutes as amended, which was approved 5-0. <br />NON-RESIDENTIAL APPEALS AND REQUESTS: <br />COMS07-0029: Wal2reens Discount Dru2s; 24584 Lorain Road: (Ward 1) <br />Case participants sworn in: Mike Lewis, Shawn Jurisch, PE - Visconsi Company; Joseph <br />George, Joseph 1Vlurray, Marilynn Soltis, Mr. & Mrs. McCartney <br />Mr. Lewis reviewed the parcels involved, the buildings to be demolished and the development <br />plan for the site. He noted that all landscaping would be irrigated as required by code. A brief <br />discussion regarding a bio-retention system being installed on the residential lot took place and <br />the board was assured that the system would improve water issues. To buffer the northern <br />neighbors the existing fencing will be replaced with an 8 foot beige vinyl fence. The 51 foot <br />building setback needed is due to the lot requiring a 100 foot setback. The entrance canopy is 48 <br />feet from the right of way and projects 4 feet beyond the building. The practical difficulty is the <br />unique size and shape of the lot (triangular) which is impossible to build upon following zoning <br />requirements. The requests are minimal and do not impact surrounding properties. Planning and <br />Design Commission recommended granting variances required. Although the site is general <br />retail the corner lot requires the multi family setback (100 feet) followed. The 5 foot sideyard <br />setback variance is for the east drive which varies in widths and abuts a retail building. The <br />bypass area requiring the 5 foot variance is the emergency lane. The Columbia Road 2 foot <br />curb-cut width is to ensure vehicles safely ingress/egress the lot. He noted the City Engineer <br />agreed the proposed width was warranted. The 26 square foot variance for signage includes two <br />wall signs, two drive-through canopy (directional) signs and a(pharmacy) window logo. Mrs. <br />Sergi felt the rear canopy sign may not be warranted. Mr. Jurisch noted there would also be <br />directional signs at the Lorain Road curb-cut (right turn only) as well as the northwest corner of <br />the building (exit only).
