Sergi moved, seconded by Ms. Rudolph, to grant COMS07-0029: Walgreens Discount <br />Drugs of 24584 Lor-ain Road a variance for 2 additional grounci signs (totaling 6 square <br />feet) 1 at Lorain road exit and 1 at the north vaest corner of the building, code allows 1 <br />applicant shows 3, section 1163.26. laoll call: Diver, Bellido, Sergi, Rudolph -yes and <br />1Vlenser -no; motion approved 4-1. <br />COMS07-0027: BP Proclucts 1Vorth America Inc; 29131 Lorain Road (Ward 3) <br />Case participants sworn in: Mr. Reid, Architect and Mr. Turner with BP Oil <br />Mr. Reid submitted updated plans which eliminated two variances and briefly summarized the <br />development plan. Due to the odd shape and the current zoning requirements no commercial <br />building could Ue constructed on the lot without variances. They are not new owners as BP has <br />owned the land for many yeaxs and currently has a non-conforming station which can not be <br />updated without multiple variances. The 17.95 foot variance is for canopy placement and to <br />allow more landscape area. The 1.5 foot variance for building sideyard setback on a corner lot <br />was 10.5 prior to eliminating a parking space. Variance not to exceed 3 feet is for the air pump <br />inoved to the northwest corner of the building. The 10.11 foot variance for rear setback is to <br />meet front setback and regulate internal traffic. Rear setback (south) provides greenspace and a <br />2 foot mound with evergreens and dense landscaping. The 22.2 foot (east) side building setback <br />is to ensure the west sideyard distance is met. Variance for light spillage relates to the front <br />western, northenl and eastern areas all of which abut commercial lots. The southern property line <br />readings are zero and those which exceeded zero elsewhere on the lot are less than 1 foot-candle. <br />Mr. Conway said today's devices cannot read any photometric levels less than 2 foot-candles so <br />the applicants readings which are less than 1 foot-candle would not be measurable. Mr. Reid <br />noted that their photometric plan did not take into account the proposed landscaping which <br />further decreases the levels. Governmental services will not be altered and all engineering <br />requirements will be met. <br />Ms. Rudolph asked if there was discussion of installing fencing. Mr. Reid said that although <br />fencing was briefly discussed it is understood that Planning & Design can request fencing. He <br />noted that the rear sidewallc along the back was installed to access mechanical equipment only. <br />Mrs. Diver's main concern is light spillage onto neighboring property. The board recommends <br />PDC look into requiring a fence or provide additional landscaping to ensure adequate buffering. <br />Mr. O'Malley said the applicant's proposal relies on the three lots being consolidated and the <br />southern parcel being rezoned General Retail. The board's variance approvals should be <br />contingent upon council's approval. Discussions of fencing along the west and south property <br />lines were debated. Mr. Reid assured the board that if PDC requests fencing or additional <br />landscaping they would comply. He noted that streetlights would create higher foot-candles then <br />their lights.
