Mr. Menser felt that all zoning requirements should be met <br />as there were other locations within the city with existing buildings which could accommodate <br />the proposed business size without variances. Mrs. Sergi said due to the size, shape and location <br />of the corner lot the variances are not substantial and she did not believe the character of the <br />neighborhood would be adversely altered. Governmental services would not be altered as the <br />bio-retention system is required by law. Owners purchase their land with knowledge of the <br />zoning laws. The property owner's predicament could not be precluded based upon the building <br />commissioner's report. A brief discussion ensued regarding being allowed to table a specific <br />variance request, all requests or opening the floor back up to clarify a specific request. Mr. <br />O'Malley advised the board of their options as outlined in their rules and the board opted to <br />allow the applicant 2 minutes to clarify the 5 foot sideyard variance requested. <br />Mr. Lewis said the east drive variance was due to the emergency bypass lane being provided and <br />clarified there was only one drive-through window. The building could not be moved west <br />without increasing the building front yard setback and the building itself was already downsized <br />to provide the larger front yard setback and greenspace along Lorain Road. Mr. George said he <br />wanted the code `enforced for the sideyard setback and noted he is opposed to the development. <br />Mrs. Sergi said that the emergency bypass was more warranted then greenspace between the <br />sites.
