BOARD OF BUILDING CODE APPEALS <br />CITY OF NOItTH OLMSTED <br />MINUTES FOR THE SPECIAL MEETING OF OCTOBEIZ 19, 2009 <br />120LL CALL <br />The meeting was called to order at 6:00 p.m. in Council Chambers. <br />Present: Donna Sabo, Norman Althen, Dan Jarachovic, Robert Lipcsey, BJ Meder <br />Staff: Assistant Law Director Bryan O'Malley, Building Commissioner Dale Mitchell, <br />Clerk of Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Jarachovic moved, seconded iby Mr. Althen, to approve the September 17, 2009 <br />minutes. Roll call: Sabo, Althen, Lipcsey, Jarachovic - yes; Meder abstained. Motion <br />approved 4-0. <br />Mrs. Sabo requested the Law Department provide a brief overview of the codes involved with <br />the pending case. Mr. O'Malley reviewed Chapter 1317 of the Codified Ordinances pertaining <br />to Registration and Licensing of Contractors. He discussed state versus local licensing. The <br />State of Ohio's contractor licenses are mainly commercial and supersede local licensing and the <br />city is bound to accept the state contractors license. The city can require a state licensed <br />contractor to register, provide proof of their state license, require they have insurance and <br />workers comp. He advised the board that although the denial referenced proof of insurance was <br />not provided, the applicant since provided the required proof therefore it was no longer an issue <br />to be addressed. <br />NEW BUSINESS <br />• Ronald Claus (RC Services LLC); 5519 Decker Road: <br />Proposal consists of an appeal of the Building Commissioner's ruling dated September 14, <br />2009 on the denial of the Application for Registration, under the compliance with the <br />codified Ordinance of North Olmsted 1317.04 d, Registration Submittals. <br />Ronald Claus was sworn in. Mr. Claus said he has always been employed by others in the <br />business since 1959. Since he retired past clients contact him requesting he provide service to <br />systems he previously worked. In Apri12009 he started his own business, RC Service LLC, and <br />starting running into problems when he started trying to register with the city. A page from <br />Ohio.gov Department of Commerce website was passed out and Mr. Claus pointed out that the <br />last sentence read "We do not license residential contractors nor do we license general <br />contractors" and he has no intention of performing commercial worlc. He only wants to work for <br />customers who he has done work for in the past for now and wants to be registered so he can pull <br />permits. Because he doesn't have a state license he can not register and he has seen the <br />paperwork and boolcs it talces but they go through a lot of requirements not needed for residential <br />worlc. He is asking the city to register him and a clause could be placed that it is for residential <br />worlc only. If he wanted to do commercial work he would take the test but he doesn't. He has
