1% <br />BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MEETING MINUTES OF IyECEMBER 3, 2009 <br />ROLL CALL <br />Mrs. Diver called the meeting to order at 7:35 p.m. in Council Chambers. ' <br />Present: Maureen Diver, Nancy Sergi, Jennifer Rudolph, Laura Bellido, Alfredo Lopez (arrived <br />at 7:45 p.m.) <br />Staff: Assistant Law Director Bryan O'Malley, Building Commissioner Dale Mitchell, Clerlc <br />of Commissions Donna Rote REVIEW AND CORRECTION OF MINUTES <br /> <br />Ms. Rudolph moved, seconded by Mrs. Bellido, to approve the November 12, 2009 Board of <br />Zoning Appeals minutes which was unanimously approved 4-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />Jerry Litchney & Diane Galdaez; 7148 Barton Road <br />Request for variance. Proposal consists of a shed and the following variance is requested: <br />An 80 square foot variance for storage shed larger than allowed, code permits 200 sq ft, applicant <br />shows 280 sq ft which is in violation of 1135.02(d)(1). Note: Over 200 sq ft requires a masonry <br />or concrete foundation. <br />Mr. Litchney was sworn in and said the variance was needed for a 14'x 20' storage shed which <br />he needs to store his vehicles and lawn equipment. He read a letter indicating why he was <br />requesting the variance (see attached). Olmsted Township which borders his property doesn't <br />have the same property standards as North Olmsted which is evident. The placement of the shed <br />will help bloclc the view of the neighboring unkempt yards. Mrs. Sergi questioned the ribbons <br />around the owner's trees and he said they were used to let the contractors lcnow which trees to <br />save. He also noted the abutting neighbor cleared trees on his vacant lot and just left them to rot. <br />Mrs. Diver aslced if the building commissioner could address the issue on the vacant lot and Mr. <br />Mitchell said it would be loolced into. <br />Mr. Mitchell does not recommend approval of the variance, which is significant. The 1ot is <br />29,392 square feet which is allowed a 200 sq ft shed. Mr. Litchney is asking for a shed which <br />requires the lot to be over an acre. He is requesting 1.4 times more than he is allowed by code. <br />The addresses noted in Mr. Litchney's letter have attached 2 car garages as well as 1%z car <br />detached-garages which are allowed by code if both garages do not exceed. 750 sq ft combined <br />and a standard 2-car garage 22'x22' and 1%z car garage 22'x12' averages 748 sq ft which is <br />allowed Uy code. Mr. Litchney asked if he would be allowed to build a detached garage without <br />a variance and Mr. Mitchell said yes as long as the combined total square footage does not <br />exceed 750 sq ft and if a foundation, downspouts and driveway are installed in accordance to <br />code. Ms. Rudolph pointed out that the only difference from building a detached garage was <br />installing a driveway as the accessory structure requires a foundation and downspouts. Mr. <br />O'Malley noted that the section of the code which stipulates the size of sheds allowed was just
