Ms. Connell-Mcdowell and Mr. Fairy, Vice President of Petro's Homes, were sworn in to <br />address the request. Mr. Petro said although the home could continue to achieve a reasonable <br />return the addition would improve the value of the applicant's home and the neighbors as well. <br />Neither the neighborhood nor governmental services would be affected by the addition. The <br />variance is not substantial as the request is in line with other decks and additions within the <br />neighborhood. Although the code was available when the owner purchased her home she was <br />not aware of the code until the permit to construct the addition was submitted. The home is a <br />split-level and is not set up to expand the upper level. The spirit and intent of the code would be <br />observed as the addition enhances the livable space. The addition does not exceed 20% lot <br />coverage and no further variances are required. Mrs. Diver questioned the use of the existing <br />pad. Mr. Fairy said a new slab would be installed to meet city codes. Mrs. Bellido felt the <br />sunroom would enhance the well kept yard and extend the owner's ability to enjoy its use. Mrs. <br />Sergi felt neither the neighborhood nor governmental services would be affected by the addition. <br />The variance is not substantial and the neighborhood was constructed as such that any exterior <br />home improvements would require variances. .Ms. Rudolph said the fenced yard would <br />minimize the addition's impact upon the neighborhood. <br />Mrs. Bellido moved, seconded by Mrs. Sergi, to grant Moya Connell-Mcdowell of 3909 <br />Walter Rd a 7' 3" variance for rear yard setback for an addition; code requires 50' and 42' <br />7" is shown which violates section 1135.08 (a) and was unanimously approved 4-0. <br />NON-RESIDENTIAL APPEALS AND REQUESTS: <br />Halleen HIA; 27726 Lorain Road <br />Request for variance (1123.12), the proposal consists of a third wall sign. <br />The following variances are requested: <br />1. A variance for 3 wall signs on a building (see note 1); code permits 2, applicant shows 3, <br />section 1163.28 (a). <br />2. A 40 square foot variance for total signage on a building (see note 2); code permits 74 sq ft, <br />applicant shows 114 sq ft, section 1163.25 (b). <br />Note• <br />1. Wall sign on the west elevation existing 37 sq' (4' 2" high) BZA approved 12/2001. Wall <br />sign on south elevation approved 12/8/08 26 sq`, propose 3Td wall sign south elevation is 51 sq', <br />2. Allowable building signage 41 +(40% of 83) = 74 sq ft allowed. <br />3. Variance granted 12/2001 allowed 2 wall signs totaling 85 sq ft which was 11 sq ft over <br />allowable sq footage for the building and the west logo sign 2 inches too high. <br />4. 12/2008 approval granted and permit issued for a new logo sign on south elevation removing <br />the existing 48 sq' box sign. Total wall signage is 63.4 sq', which is 11 sq' under allowable. <br />5. 4/2009 variance request is to add a 51 sq ft wall sign on the south elevation. <br />Eric Halleen, Mr. Belknap with Agile Sign & Lighting, and Mr. Pacsuta, a neighbor, were sworn <br />in. Mr. Belknap said a permit for the logo was approved by the Building Department in <br />December and the previous sign company was not aware the existing wall sign needed to be <br />removed. The KIA brand wants all dealer signs separated from the KIA logo. The west wall <br />sign which is a KIA logo will remain and the variances are for a logo and owner's sign on the <br />south elevation.
