but there is no intent to make changes other than what Mr. Vivianni has agreed to do. Mr. Rerko
questoned the site plan from Herschman Architects and Mr. Lander said the site plan was an old
plan provided to him by the realtor so parking could be shown. Mr. Rerko said there was no way
to lcnow what parking is currently available on the site as the plan submitted was prior to the road
widening. Mrs. Merdith said 1118.03(d) addresses on-site and off-site traffic generation and
circulation patterns related to the use shall not adversely impact adjacent uses or result in
hazardous conditions for pedestrians or vehicles in or adjacent to the site. Therefore the parking
lot is part of the conditional use review.
Mr. Cotner felt the violations existed before the road widening and the parking lot is not safe due
to the number of pot holes, loose gravel and no identifiable parlcing spaces or traffic direction.
Mr. Malone agreed the condition of the parking lot was related to the conditional use review;
however prior to the applicant spending money on interior changes they should know whether or
not the commission believes the proposed use is acceptable. He would not object to the
conditional use if the parking lot issues were resolved. Mr. Rerko agreed. Mr. Lasko said
reviewing the conditional use permit standards in 1118.03 the proposed use is the same as the
last use which was assembly. Applying the standards the use would meet the conditions of
1118.03 other than paragraph (d) which relates to the conditions of the parking lot. Therefore the
commission proposes to postpone addressing the request until the court case is resolved as it
relates to the condition of the parking lot. If the parking lot was resolved to the satisfaction of
the Engineering and Building Departments, the proposed use would be agreeable. All
commission members agreed. The applicant asked when the conditional use permit would return
and Mr. O'Malley said the commission should base the applicant's return on the owner applying
for, obtaining approval and completing the parking lot improvements to the City's satisfaction.
Mr. Mitchell requested a photometric plan showing all existing or proposed lighting.
Mr. Lasko moved, seconded by 1VIr. Bohlmann, to table CMS09-09 Sovereign Grace
Church of 29047 Lorain Road to a later date predicated upon the resolution of the issues
pertaining to the parking lot as they relate to the conditional use permit which was
unanimously approved 7-0.
COMMUNICATIONS
Ms. Wenger invited everyone to attend the City's 100' birthday celebration on Friday, August
28, 2009 at 7:00 pm at North Olmsted Park as part of the homecoming festival.
ADJOURNMENT
With no further business the meeting was adjourned at 9:10 pm.
/033
?ak
J J.
