spaces however upon viewing the site the existing parking spaces total 174. In accordance to <br />code, the total building area is 44,873 square foot which requires a minimum of 179 parking <br />spaces and maximum of 215 spaces. The proposed wall sign meets code and earlier in the year <br />during commercial property maintenance inspections, the site was cited for several maintenance <br />violations. During the inspection the Assistant City Engineer observed that 70% of the existing <br />asphalt was deteriorated; therefore a full-asphalt surface replacement is required. <br />Mr. O'Malley said there are nine charges in the Rocky River Municipal Court pertaining to <br />property maintenance issues. The owner has initiated some of the maintenance improvements. <br />The issues will be addressed by the court on 9/29/09 and the city is awaiting further compliance <br />by the owner. The commission's review should not address real property maintenance issues <br />specifically as the applicant is before the commission for a conditional use permit. He <br />recommended the commission table the matter until the maintenance issues were resolved. Mr. <br />Lasko expressed confusion over the Law Department's conflicting recommendations. He asked <br />if any tenant could receive occupancy permit despite the property maintenance issues in court <br />and Mr. Mitchell said as long as the Ohio Building Code is met occupancy pernuts would be <br />issued. Mr. O'Malley said the building department is bound to follow Ohio Building Code and <br />local zoning laws are separate from State laws. <br />Mr. Bohlmann said the site has been an eyesore for a long time and felt that the matter should be <br />tabled until the property maintenance issues were settled. Mr. Cotner said the condition of the <br />parking lot is such that it would not be safe for any pedestrian traffic. He would not approve a <br />conditional use permit without the parking lot being replaced, sealed and restriped. Ms. <br />Williamson said there was no clear striping to identify parking spaces on the site and the lighting <br />of the parking lot is insufficient for pedestrian traffic in the evening. <br />Mr. Lander said there were arrangements to address the parking lot and building according to the <br />property manager. They proceeded with the understanding these issues would be addressed. <br />The occupancy should be 225 not 200. Mr. Viviani said the reason the property issues were not <br />addressed is that the property sale fell through in August. They are now commited to repaving <br />the drive lanes at the parlcing lot, patching and sealing the rest of the lot and restriping. They <br />will also clean up the entire front if the bank approves the funds to complete the projects, but he <br />doesn't know how far the funds will go. Stearns Road construction caused him to lose two <br />tenants and the site will not get any better if they don't have tenants. His tenant is seeking a <br />conditional use permit and it has nothing to do with property maintenace issues. Mr. Lander <br />asked if they could move forward to get a demo permit to start internal work to keep the process <br />moving. Mr. Mitchell said Mr. Vivianni could submitt an application for interior demolition <br />without a tenant to clean up the space. <br />Mr. Rerko said the notes indicate four classrooms which are not identified on the drawing and <br />Mr. Lander said the rooms identified as offices would also be used as classrooms during <br />services. Mr. Lander said there would be office hours during the week and service hours would <br />be Sundays 10:00 am to 12:00 pm. Classrooms would be used during service times for <br />children's ministry. There will be some evening meetings. Mr. Rerko asked if there would be <br />any exterior building modifications and Mr. Lander said that the current windows are blaclced <br />out which would be removed and they will polish up those exterior issues needing to be cleaned,
