loolced at purchasing the vacant land to the east to provide additional parlcing. Mr. Chambers
indicated that the matter was loolced at but not feasible or realistic at this time.
Mr. Maloney read a letter from the homeowners association objecting to the curb cut. Mr.
Sabala said he was against the curb cut. When the snow is plowed the vehicles stacked along
their streets bloclc traffic flow and mailboxes. The proposed curb cut would add to traffic
congestion and would create traffic hazards. Since the widening of the road vehicles exiting the
neighborhood have to cross four lanes of traffic to travel east which is difficult. Mr. Christou
said that Chambers had been a good neighbor but the curb cut will add to the existing vehicle
problems within the neighborhood. He is concerned that lighting will affect his home as his
home is the first on the street. If pole lights are not allowed he would like to see all the light
poles in the area removed as well. Mr. Canley said that when the funeral home was first
proposed the residents were assured there would be no curb cut onto Pheasant Wallc and the
vehicles would not be stacked along the streets which takes place. He encouraged the
coininissioners to not allow the curb cut. Mr. Lasko said the lighting which was previously
approved can not be changed however the applicant has agreed to install a full cutoff fixture
which will alleviate lighting issues.
1VIr. Lasko moved, seconded by Mrs. Meredith, to recommend that the BZA grant a
variance to CMS09-03: Chambers Funeral Homes Inc of 29150 Lorain Road for a curb cut
within 100' of an intersection, which was unanimously, denied 0-7.
Mr. Lasko movecl, seconded by Mr. Malone, that based on the deletion of the proposed
curb cut onto Pheasants Walk and the new wall light installed being a full cutoff fixture
which complies with cocle or new plans using bollard lights being submitted, the plan is
appiā¢oved as amended which was unanimously approved 7-0. Mr. O'Malley advised the
applicant was not compelled to seek a variance for the curb cut if he withdraws his request. Mr.
Chambers said he would not seelc any variances.
COMMUI`1ICATIONS
Ms. Wenger requested replies from commissioners who would attend the upcoming audio/web
conference by February 18, 2009.
ADJOiJRN1VIENT
The meeting was adjoui-ned at 8:50 pm.
J J.
